New York City Rules and Regulations

The laws and rules of the City of New York are published in the New York City Charter, the New York City Administrative Code and the Rules of the City of New York. The most updated versions of these publications are available on the American Legal Publishing (ALP) website. Visitors may use the "Search" button at the top of the ALP website to find topics across all three publications.

New York City Charter

The New York City Charter defines the organization, functions, and essential procedures and policies of NYC government. NYC DOT's authority can be found in Chapter 71 of the New York City Charter.

New York City Administrative Code

The New York City Administrative Code contains the codified local laws of New York City enacted by the New York City Council and Mayor.

The majority of local laws pertaining to NYC DOT can be found in Title 19 of the New York City Administrative Code, however, other titles—including, but not limited to—Title 7 and Title 10 of the New York City Administrative Code contain local laws relevant to NYC DOT.

Rules of the City of New York

The Rules of the City of New York contain the rules and regulations for New York City Agencies. NYC DOT's rules can be found in Title 34 of the Rules of the City of New York.

Staten Island Ferry rules can be found in Chapter 1 of Title 34 of the Rules of the City of New York.

Highway Rules can be found in Chapter 2 of Title 34 of the Rules of the City of New York. Chapter 2 includes rules regarding street construction permits, permit fees, requirements for sidewalk, curb and roadway work, flood mitigation systems, and other related information. NYC DOT's Penalty Schedule can be found in Chapter 3 of Title 34 of the Rules of the City of New York. Chapter 3 lists penalties associated with NYC DOT violations that are adjudicated at the Office of Administrative Trials and Hearings (OATH) through the Environmental Control Board (ECB). Traffic Rules can be found in Chapter 4 of Title 34 of the Rules of the City of New York. Chapter 4 includes rules regarding traffic signals, parking, bicycles, moped share and carshare, pedestrian plazas, buses, taxi/for-hire vehicles, trucks, and other related information. Rules about Revocable Consents can be found in Chapter 7 of Title 34 of the Rules of the City of New York. Chapter 7 includes rules about applications, requirements, and fees related to obtaining a revocable consent. Review all Revocable Consents on ALP

NYC DOT adopted rules amending the Traffic Rules relating to the permanent carshare parking program. The rule became effective on May 25, 2022.

Notice of Adoption – Various Amendments to the Traffic Rules
NYC DOT adopted rules relating to removing bicycles left unattended on bike racks, requiring vehicles and bicycles to stop for pedestrians in crosswalks when traffic controls are not in place or in operation, and adding an exception to the prohibition on the obstruction of New York State license plates. Additionally, Chapter 8 of Title 34 of the RCNY is repealed. The rules became effective on January 19, 2022.

Notice of Adoption – Traffic Rules Amendment relating to Temporary Emergency Food Delivery Program
NYC DOT adopted rules relating to Traffic Rules exempting drivers and vehicles delivering frees meals to participants in the NYCEM temporary emergency food delivery program from parking and standing rules for a period of up to 20 minutes. The rule became effective on September 21, 2020.

Notice of Adoption – Traffic Rules Amendment relating to Plaza Exclusive Seating Pilot Program
NYC DOT adopted rules relating to a pedestrian plaza exclusive seating pilot program at the following five plaza :(1) Fordham Pedestrian Plaza, (2) Myrtle-Cooper Pedestrian Plaza, (3) Myrtle-Wyckoff Pedestrian Plaza, (4) Diversity Pedestrian Plaza, and (5) Corona Pedestrian Plaza. The program will allow for no more than 20% of all seating in the pedestrian plaza where there is a concession to be reserved for patrons, subject to DOT review and approval. The rule became effective on April 15, 2020.

Notice of Adoption – Traffic Rules Amendment relating to Bus Stop Permits
NYC DOT adopted rules relating to updating provisions of the Traffic Rules to conform with Local Law 175 of 2018, which requires sight-seeing bus operators to apply for on-street Bus Stop Permits from the New York City Department of Transportation and updating the parkway permit rule to allow heavier vehicles on the Belt Parkway. The rule became effective on February 9, 2020.

Notice of Adoption – Shipping Container Trucks Rule
NYC DOT adopted the rule to allow oversized trucks hauling sealed shipping containers to travel to or from New Jersey across the Goethals Bridge to or from the Howland Hook Global Container Terminal in Staten Island on a legal, safe route along the streets of New York. This rule became effective on Saturday, January 20, 2018.

Notice of Adoption – NYC DOT Pedestrian Plaza Rules
NYC DOT adopted rules that create a regulatory framework for the Department’s pedestrian plazas by adding definitions to section 4-01 and a new section 4-16 to the Department’s rules. The rules, among other things, formalize an application process by which the Department will designate pedestrian plazas; impose uniform rules of conduct for all pedestrian plazas; and create specific rules for the Times Square Pedestrian Plaza. The rules took effect on Monday, June 20, 2016.
