The OATH Hearings Division holds hearings on what are called Environmental Control Board, or ECB cases. These cases involve summonses that are issued by more than 25 different City enforcement agencies responsible for protecting the public's health and safety and ensuring it has a clean environment. OATH Hearing Officers' decisions on these summonses are final unless an appeal from the hearing decision is filed and accepted. Either side (the respondent or the City agency) can appeal. If an appeal has been accepted, the OATH Appeals Division reviews the arguments made on appeal, as well as the hearing record, to determine whether the hearing decision is supported by the law and by a preponderance of the evidence in the record. It then drafts a decision on the appeal and presents it to a monthly panel composed of three rotating members of the ECB. The panel reviews the draft decision and votes to adopt or modify it. If the panel members are unable to reach an agreement on a particular decision, the appeal is referred to the full ECB to discuss and vote on the outcome. Appeal decisions issued after review by a panel or the full ECB are final.

Being an ECB board member is a fantastic way to serve the public and lend your voice to government. The six Mayoral-appointed members serve four-year terms and represent different specialties and backgrounds, including air pollution control, water pollution control, noise pollution control, real estate, and business. The members are responsible for reviewing and approving appeal decisions regarding summonses; providing oversight of rules relating to adjudications; making appropriate legal recommendations with regards to legislative matters, policy and regulatory issues; and enforcing certain provisions the administrative code, and rules and regulations made thereunder. The Board holds public meetings (1-2 hours) every two months where ECB members meet to review current issues, and between meetings the ECB members review draft appeal decisions and confer with other members. ECB members are compensated for their time attending ECB meetings and reviewing cases outside of meetings.
Applicants with experience or interests in the areas of water pollution control, real estate, and the business community are encouraged to apply.
