Service Suspension/Termination for Non-Payment

All businesses are required by law to hire and retain zone-authorized carters to collect their commercial waste.

Your carter is permitted to suspend or terminate your service if you are more than 45 calendar days late in payment.

If your cater intends to suspend or terminate services due to non-payment, your carter must follow specific notification requirements pursuant to Section 20-22(b) of Title 16.

If your carter has suspended or terminated your service for non-payment, you can submit an appeal.

The carter is not obliged to provide service while you are going through the appeal process. Any late payment fees set forth in your contract may continue to accrue on unpaid invoices. 

Carter Notification Requirements

Your carter must follow certain procedures before suspending or terminating your collection service for non-payment pursuant to Section 20-22(b) of Title 16.

30 Days Past-Due

If you are 30 calendar days late on paying your carter, your carter must notify you in writing that:

  1. Your payment is past-due, and;
  2. Your service may be suspended or terminated if you are more than 30 calendar days late.

45 Days Past-Due

If you are at least 45 calendar days late on paying your carter AND they have sent you the 30 Days Past-Due notification, they can suspend or terminate your service. 

In order to suspend or terminate your service, your carter must notify you by certified mail and include the following information:

  1. Your service is being suspended or terminated;
  2. The reason why your service is being suspended or terminated, and;
  3. The process for appealing the suspension or termination to DSNY.

Appeals Process for Suspension or Termination of Service

Once you have received the 45 Day Past-Due notice, you have 60 calendar days to submit an appeal to DSNY. Appeals can only be granted if they meet at least one of three grounds.

The three grounds for appeal are:

  1. Carter did not follow required Notice Requirements
  2. Billing dispute/incorrect charges
  3. Payment was made or attempted or a payment plan was created

Carters may continue service during the review process at their discretion, though late fees can still accrue.

Filing Your Appeal

If your carter suspended or terminated service due to non-payment and it has been less than 60 days since you received the 45-day past-due suspension or termination notice (or the notice was not received), you can submit an appeal to DSNY.

Sending Appeals Package to Carter

IMPORTANT: You must ALSO send this appeal package (form and documentation) to your carter, as required by law. Your carter's contact information can be found in your contract/service agreement.
