The Department of Consumer and Worker Protection (DCWP) Commissioner Samuel Levine issued the following statement on food delivery app cases:
Today’s court ruling in Doordash Inc. and Uber Technologies, Inc. vs. The City of New York affirms that multi-billion-dollar companies need to comply with laws that protect workers and consumers. As a recent DCWP report revealed, the interface design tricks that Uber and DoorDash engineered to make it harder for consumers to tip reduced worker compensation by more than $550 million. Those days are over. We look forward to enforcing Local Laws 107 and 108 to ensure that workers get paid, and consumers have the option to tip freely.
Today’s court ruling in Maplebear Inc. vs. The City of New York, et al. affirms that grocery delivery workers are guaranteed the same minimum pay rate and tipping standards as restaurant delivery workers. DCWP will continue to vigorously enforce New York City's Delivery Worker Laws and hold Instacart and other companies that try to skirt the rules accountable. Algorithms do not deliver groceries; people do.
