The CSC’s Timeliness Appeal Process

You must first explain why your appeal was late

After submitting a copy of the agency appeal panel’s late appeal notification and receiving the CSC’s Acknowledgment of Appeal (“AoA”) notice, you must submit an explanation addressing the reasons for the delay in filing your appeal to the agency appeal panel.

Note: Please make sure your explanation includes specific reasons as to why you submitted your appeal late to the agency appeal panel. For example, include dates, times, supporting documentation regarding the reasons for your late appeal,

Your explanation for your late appeal must be emailed to both the CSC at appeals@nyccsc.nyc.gov and the hiring agency within 5 days of the CSC’s AoA being issued to you. Please note that the agency’s email contact information will be included in the AoA that you receive from the CSC. 

Failure to submit an explanation to the CSC within 5 days of the AoA may result in your appeal being dismissed.

 

Report Deadline is issued by CSC

Once your timeliness explanation is received, the CSC will then set a date for the hiring agency to submit a report.

If the hiring agency chooses to deem your appeal timely

The hiring agency in responding to your timeliness appeal, may choose to deem your appeal as timely instead of submitting a report.

If DCAS or NYCTA chooses to have your appeal remain untimely

Alternatively, the hiring agency may choose to submit a report explaining why the agency review panel deemed your appeal to be untimely. The CSC will complete a review of your lateness explanation and the agency’s report and issue a decision. If the CSC determines that your appeal is timely, it will order the agency review panel to conduct a review of the reasons for your disqualification.

Please note that if the CSC issues a decision deeming your appeal timely, your CSC timeliness appeal will be closed and the agency review panel will be handling your disqualification appeal on the merits. Therefore, you will have to contact the agency review panel for updates on the status of their review of your disqualification. However, if the agency review panel denies your appeal and issues a new determination with instructions that you may appeal to the CSC, you may submit a new appeal request to the CSC to review this determination.
