Resolving DOB Parking Structure Violations
Challenging Parking Structures Compliance Violations
Owners who believe their property is not subject to the requirements of 1 RCNY 103-13 or 1 RCNY 103-16 should follow below procedures to challenge violations received and avoid receiving additional violations in the future.
Properties Exempt from Filing a Full Compliance Report per 1 RCNY 103-13
The following properties are exempt from filing periodic parking structures inspections:
- unenclosed and unattached outdoor parking lots
- autobody repair shops, automotive repair shops, automotive showrooms, and automotive service stations
- properties with first Certificate of Occupancy of Temporary Certificate of Occupancy issued less than 6 years prior to the sub cycle filing deadline
- parking structures with less than three (3) parking spaces
- private garages serving one- and two-family homes as defined in Chapter 2 of the NYC Building Code.
Properties Exempt from Filing an Initial Observation Report per 1 RCNY 103-16
The following properties are exempt from filing an initial observation report of parking structures:
- any property that is exempt from 1 RCNY 103-13
- properties in Manhattan Community Districts 1-7
- properties in Manhattan Community Districts 8-12 and Brooklyn that filed a full compliance report per 1 RCNY 103-13 by August 1, 2024.
Challenging a DOB Violation for Failure to File an Inspection Report
Owners have two options for challenging a DOB violation:
- File a Waiver of Civil Penalties request in DOBNOW, providing evidence of being exempt from inspection requirements.
or
- Email ParkingStructures@buildings.nyc.gov and provide the violation number, address, and exemption evidence from 1 RCNY 103-13.
Challenging an OATH/ECB Violation for Failure to File an Initial Observation Report
Email ParkingStructures@buildings.nyc.gov and provide the violation number, address, hearing date, and and exemption evidence from 1 RCNY 103-13. Requests to reschedule OATH hearings may be submitted on the OATH website.
Remedying Violations
To remedy a Failure to File a Parking Structures Technical Report (NRF):
- A Qualified Parking Structures Inspector (QPSI) must submit an acceptable initial Periodic Inspection of Parking Structures technical report in DOB NOW: Safety.
- Pay the applicable penalties for late filing ($1,000 per month) and Failure to File ($5,000 per year).
To remedy a violation for Failure to Correct Unsafe Conditions:
- The unsafe condition resulting in an unsafe technical report status must be corrected and a QPSI must submit an acceptable PIPS amended technical report in DOB NOW: Safety
- Pay any outstanding penalties for failure to correct an unsafe condition - See schedule in 1 RCNY 103-13 for the period with no active repair extension request(s) submitted prior to the submission of the acceptable amended PIPS technical report.
To remedy a violation for Failure to Correct SREM Conditions:
- Once conditions have been corrected, a QPSI must file an amended report.
- Pay any outstanding penalties for failure to correct SREM conditions only after an amended report has been accepted.
