The easiest way to appeal a decision, respond to an appeal filed by the opposing party, or request more time to file an appeal or respond to an appeal is by using OATH's universal electronic Appeal Application one-click form because it will send the appeal (or response or extension request) at the same time to both the Appeals Division and the agency that issued you the summons. If you do not file your appeal, response, or extension online, there will be extra steps you need to take to file by mail.

You must submit your online appeal within 30 days of the date of the hearing decision, or 35 days of the date of the hearing decision if the decision was mailed to you. You can find the date of the decision next to the judicial hearing officer’s signature on the last page of the decision.

If you received a default judgment, do not use this form. You must file a motion to reopen the defaulted case.

Note: Some summonses alleging violations of New York City’s Air Code, including idling an engine, and Noise Code may be issued by Citizen Petitioners instead of by a City government agency. If your summons was issued by a Citizen Petitioner, it will state “CITIZEN PETITIONER:” followed by that person’s name at the top of the summons. In the “Case Type” drop down menu below, please select “Citizen Petitioner.” Please note that this online form will not automatically serve a copy on the Citizen Petitioner. Instead, you must save a copy of the confirmation page that displays after you submit this form. You must then serve the confirmation page along with a copy of your appeal on the Citizen Petitioner by sending it to that person’s contact information listed at the top of the summons. By selecting “Citizen Petitioner” you are affirming under penalty of perjury that following submission of this form, you will serve a copy of the confirmation page on the Citizen Petitioner at the contact information listed for that person on the summons.
