Even if your income is over the Medicaid limit, you may be eligible for the Medicaid Excess Income Program. You may have also heard this program called the “Surplus Income Program” or the “Spenddown Program.” Here we will be referring to it as the Excess Income Program.
This program will let you get Medicaid on a month-to-month basis or get coverage for up to six months at a time. To get coverage, you can make a payment or submit itemized medical bills to meet the amount you are over the limit, also called your surplus. You must meet your surplus to get Medicaid coverage.
You can make payments to the Division of Accounts Receivable and Billing (DARB). Payments received by DARB will be submitted to the Medicaid Excess Income Program for evaluation.
Note: If you belong to a Medicaid Long Term Care program, you must pay your provider. If you need help determining where to make your payments, please call 888-692-6116 for instructions on how to proceed.
Medicaid coverage under the Excess Income Program can only be authorized when the payment is made using a recipient's own net available excess income. Payment must be made by the recipient, a legally responsible relative living with the recipient whose income is counted in the recipient's Medicaid budget, a legally responsible third party (guardian, power of attorney, etc.) using the recipient's own funds, or a third party who attests to the fact that they are using the recipient's funds.
If you are a third-party making a payment for someone you are not legally responsible for, you must attest that the funds used to make this payment from your account(s) on behalf of the recipient were provided to you by the recipient for whom you are making a payment by completing and sending us the MAP-3107a - Attestation of Use of Recipient Funds form. This form only needs to be submitted one time. Forms can be faxed to the Medicaid Excess Income Program at 917-639-0645. Please submit the form to the Medicaid Excess Income Program at least two weeks before the first payment submission to prevent any processing delays.
