Work Without a Permit Violations

Purpose:

To provide a designation on the property profile index screen (BIS) to indicate whether a violation is for work without a permit, so that civil penalties pursuant to Administrative Code 26-212.1 (Local Law 58/88) can be assessed. This amendment is necessary to avoid open DOB violations from appearing on the index where the corresponding ECB violation has been properly lifted, and to capture civil penalties for all pending work without a permit violations, including unserved violations and violations which have not yet been data entered into AIMS by AEU. The table of infraction codes in the original PPN did not include Boiler work without permit violations.

Specifics:

DOB Violations: 

If an inspector issues a DOB violation for work without a permit, the data entry clerk enters the violation into BIS in the following way:

Enter issue date, violation type and violation number. After the statement "Work w/o permit? Enter Y or N," type a "Y" in the box. This will result in a "VW" appearing on the index actions screen for DOB violations. You must also indicate that the violation is NOT an ECB violation by typing an "N" in the box after the statement "ECB" violation. "Enter Y or N."

ECB Violations 
If an inspector issues an ECB violation for work without a permit, the data entry clerk enters the violation into BIS in the following way:

 

Enter issue date, violation type and violation number. After the statement "Work w/o permit? Enter Y or N," type a "Y" in the box. You must also indicate that the violation IS an ECB violation by typing a "Y" in the box where the screen says "ECB" violation. Enter "Y" or "N". You will be required to enter the ECB number. This will result in a "VPW" appearing on the index actions screen for ECB violations.

DO THIS FOR ALL ECB VIOLATIONS FOR WORK WITHOUT A PERMIT, SERVED AND UNSERVED.

The ECB violation will appear on BIS as "VPW" until it has been data entered by the Administrative Enforcement Unit into AIMS (the Environmental Control Board's database, formerly known as BARAMIS.) After data entry by AEU, the "VPW" violation will disappear, and the ECB violation will replace it. The violation will now appear on the index as "VECB" unless the violation was an elevator work without a permit violation. Elevator work without a permit violations (B8F) will appear as "VECW".

Whenever the Environment Control Board approves a new infraction code for work without a permit, that information should be forwarded by the Administrative Enforcement Unit to the Information Technologies (IT) division head for inclusion into the civil penalties Infraction Code Table on BIS.
