Violations of Safety Inspection Record Keeping Rules
BIC urges you to share the following information with your trade waste drivers. This is an important notice regarding compliance with BIC’s safety record keeping requirements.
BIC rules require the following records to be available in the corresponding trade waste vehicle at all times in either paper or electronic form:
• Copies of inspection and certification of repair forms for the most recent six-month period (see 17 RCNY § 5-03(m) for licensees or 17 RCNY § 7-06(e) for registrants); and
• Copies of daily vehicle inspection reports for the last fourteen (14) days (see 17 RCNY § 5-03(n) for licensees or 17 RCNY § 7-06(f) for registrants).
If you utilize an electronic form of record keeping, the driver must be able to access and provide the relevant documents when asked to do so by a member of BIC’s enforcement team. If a driver cannot retrieve the documents when requested, your company may be subject to enforcement action.

This notice is a reminder that all trade waste hauling vehicles with a gross vehicle weight rating (“GVWR”) over 10,000 pounds must be in compliance with the side guard law, Local Law 56 of 2015, as amended by Local Law 108 of 2021, by January 1, 2023. Licensees and registrants that fail to provide proof of compliance with the side guard requirement by that date will be subject to a violation.
Licensees and registrants are encouraged to provide proof of compliance with the side guard requirement well before the January 1, 2023 deadline. You may now submit proof to BIC for each vehicle in your fleet equipped with side guards, on a voluntary basis.
Documentation for each vehicle equipped with side guards can be uploaded through the BIC Online Portal. See the guide attached to this notice for more information on how to report proof of side guard installation for each applicable vehicle. Please be advised that providing false information to BIC, including information provided through the BIC Online Portal, is a violation of the Commission’s Rules (see 17 RCNY § 1-09), which may subject you to civil penalties of up to $10,000 for each such violation, and could adversely affect your license or registration status.
In the coming months, the Commission will finalize rules to provide further guidance on the side guard requirement and introduce a process to apply to the Commission for a waiver of the requirement in instances where installation of side guards is impractical for a particular vehicle. A separate notice regarding the waiver application process is forthcoming.
A list of vendors that install side guards can be found here. Selection of side guard type, supplier, and installer are at the discretion of the licensee or registrant.
Please be advised that on August 1, 2022, New York City’s expanded speed camera law goes into effect. The City will be able to issue violations 24 hours a day, 7 days a week, year-round. NYC DOT is authorized to operate speed cameras in 750 school speed zones. By getting drivers to slow down, the City will prevent crashes, protect New Yorkers from injury, and save lives.
Speeding in a school speed zone may mean a $50 ticket for the person to whom your vehicle is registered. It is illegal to speed anywhere within the City of New York, but the placement of speed cameras is limited to school speed zones – streets within a quarter-mile radius of school buildings. Drivers should always drive at or below the speed limit, regardless of where they are.
In 2014, New York City reduced its speed limit to 25 MPH in order to make the city safer for pedestrians, cyclists, and drivers. While speeding has decreased, it remains a major factor in fatal crashes. The faster a vehicle is moving, the harder it is for the driver of that vehicle to avoid a crash. Even a small difference in vehicle speed makes a big impact in terms of safety – a pedestrian who is struck by a vehicle travelling at 30 MPH is twice as likely to be killed as a pedestrian struck by a vehicle travelling at 25 MPH.
