Tenant's TPP Checklist

If construction is happening in your building, it’s your job to stay safe and it is your landlord’s job to provide the required safety measures to keep you and your neighbors safe during construction. The location where the work is happening should be physically separated from any areas occupied by tenants.

But, before any work can begin, your landlord must distribute a Tenant Protection Plan Occupants Notice. The notice must also be posted in a highly visible location in the lobby of your building and on each floor within ten feet of the elevator, or if your building doesn’t an have elevator, the notice should be posted in the main stairwell. Notices must be visible to the eye.

Once you receive the Tenant Protection Plan Occupants Notice, make sure the notice includes the following:

  1. The permit number(s) for the associated work. With this information you can track the permit application history online either through DOB’s Building Information Systems (BIS) or the DOB NOW Public Portal. Once your property owner files a permit application to correct the condition, you can sign up for automatic Job Status updates.

    Using the DOB NOW Public Portal, fill in the house number, street name and borough and click Search.

    Using BIS, fill in the address of the building and click Go. This will bring you to the Property Profile. Scroll to the bottom left to Job Filings. Then select the corresponding Job Number.

  2. The building address and location(s) of the proposed work. Use this information to obtain job status either through DOB’s Building Information Systems (BIS) or the DOB NOW Public Portal.

  3. The name and contact information for the responsible party. The contact information listed must be for the name of the individual provided on the notice. The contact person can be any of the following individuals: Site Safety Manager, Site Safety Coordinator, Construction Superintendent, Property Owner/Owner’s Representative.

Additional Information

  • Report a TPP issue. If you believe the contractor is not following the TPP, you can place a complaint through 311, ask that your complaint be directed to DOB’s Multiple Dwellings Inspections Unit and specify Tenant Protection Plan.   • Construction noise. All noise complaints are handled the by the NYC Department of Environmental Protection (DEP). You can place a complaint through 311.

  • Complaint about dust from construction. To place a complaint about construction dust, contact 311. Ask the 311 Operator to direct the complaint to both the Department of Buildings and the Department of Health and Mental Hygiene. Then, contact the Office of the Tenant Advocate at (212) 393-2949 or by email at tenantadvocate@buildings.nyc.gov.

  • Asbestos Contamination. If you suspect asbestos contamination, please refer the complaint to the NYC Department of Protection by calling 311. Suspected lead contamination should be referred to the NYC Department of Health and Mental Hygiene.
