AEUHAZ (Immediately Hazardous) Violations

AEUHAZ Violations are issued for failure to submit a Certificate of Correction (COC) for a Class 1 (Immediately Hazardous) OATH/ECB Summons. The civil penalty for an AEUHAZ violation increased from $3,000 to $5,000 for summonses issued on or after May 15, 2022, at a construction site that is not a one- to four-family home.  The civil penalty is separate from any fines imposed by OATH/ECB for the underlying Class 1 summons. Challenge an AEUHAZ Violation

The property owner and/or respondent may submit a challenge to the AEUHAZ violation within 30 days of the Notice of Violation issued date. To submit a challenge, log in to DOB NOW, select +Waivers and Challenges and AEUHAZ. Search for the violation, add it to the request, and select one of these challenge reasons:

  • Certificate of Correction was approved before AEUHAZ Violation was issued 
  • OATH Summons was dismissed
  • OATH Summons was downgraded to a lesser violation at hearing
  • Penalty was issued to a one-to-four-family dwelling on or after May 15, 2022
