AEUHAZ Violations are issued for failure to submit a Certificate of Correction (COC) for a Class 1 (Immediately Hazardous) OATH/ECB Summons. The civil penalty for an AEUHAZ violation increased from $3,000 to $5,000 for summonses issued on or after May 15, 2022, at a construction site that is not a one- to four-family home. The civil penalty is separate from any fines imposed by OATH/ECB for the underlying Class 1 summons. For more information, see 1 RCNY§102-05.

The property owner and/or respondent may submit a challenge to the AEUHAZ violation within 30 days of the Notice of Violation issued date.
