PUBLIC NOTICE IS HEREBY GIVEN THAT in accordance with New York State Public Authorities Law, on January 26, 2018, the New York City Water Board (the Board) will hold a public hearing concerning certain amendments to the Board’s Rate Schedule first intended to be effective as of July 1, 2016 (the “FY 2017 Rate Schedule”), in light of the December 19, 2017 decision by the New York State Court of Appeals in In the Matter of Prometheus Realty Corp., et al. v. New York City Water Board, et al., which reversed a lower court order and put into effect that FY 2017 Rate Schedule. The hearing will be held as follows:

The Board will consider the following amendments to the FY 2017 Rate Schedule:

  1. The Board will consider action to repeal the 2.1% increase to the metered and unmetered water rates and rate-based billing programs that was promulgated in the FY 2017 Rate Schedule.
  2. For properties that were automatically enrolled in the Multiple-family Conservation Program (MCP), the Board will consider an extension of the grace period for MCP non-compliance from December 31, 2016 to December 31, 2018.

All of the other fees, programs, terms and conditions and other items included in the FY 2017 Rate Schedule shall remain in effect.

The hearing is open to the public. Anyone may attend or register to speak. Those who wish to testify at the hearing should contact the Board by email: nycwaterboard@dep.nyc.gov, telephone: (718) 595-3594, or mail: New York City Water Board, 59-17 Junction Boulevard, 8th Floor, Flushing, NY 11373, to register no later than 12pm on January 25, 2018. Oral testimony will be limited to five (5) minutes duration. A copy of any prepared or written statement may be submitted for the Board’s consideration at the above email or mailing address by 12pm on January 25, 2018.
