The company seeks a variance of section 24-163 of the New York City Pollution Control Code on the basis of its business need to provide passenger comfort as a non-emergency transportation service provider. The application states that as part of its contract with New York State Office for People with Developmental Disabilities. there is a condition to maintain temperature within the vehicle between 60- and 78-degrees Fahrenheit (or at least 15 degrees Fahrenheit lower than outside air temperature when the outside temperature exceeds 93 degrees) in its 218 fossil-fuel powered medium duty vans.
