The company seeks a variance of section 24-163 of the New York City Pollution Control Code on the basis of its business need to provide passenger comfort as a non-emergency transportation service provider. The application states that as part of its contract with New York State Office for People with Developmental Disabilities. there is a condition to maintain temperature within the vehicle between 60- and 78-degrees Fahrenheit (or at least 15 degrees Fahrenheit lower than outside air temperature when the outside temperature exceeds 93 degrees) in its 218 fossil-fuel powered medium duty vans. The stated need is due to potential medical issues for the occupants that could occur when interior temperatures are not within the specified parameters. The variance application states that the company is exploring electric vehicles and that if it finds electric vehicles that meet its operational needs, it will set up charging terminals.
