Appendix A

Summary of Application Referral, Hearing Notice, and Proof of Service Requirements

This Appendix is provided as a summary. Please see the full text of the associated rule for all requirements.

If the subject property is located within more than one Community Board, the applicant must also refer the application and provide notice to the affected borough board.

Zoning Calendar (BZ) Variance, Reinstatement, Major Amendment

  • Application Referral – within three (3) days of filling must send copies to:
    • Community Board
    • Borough President
    • City Council Member
    • Administrative Official who issued the determination
    • City Planning Commission

  • Must submit Proof of Service of Referral within ten (10) days of filing.

  • Hearing Notice – must send notification at least twenty (20) days before hearing to:
    • Community Board
    • Borough President
    • City Council Member
    • City Planning Commission
    • Affected Property Owners
    • Publish in newspaper, one day of each week for two (2) of the three (3) weeks before hearing
  • Must submit Proof of Service of Hearing Notice within ten (10) days of sending the notice.

  • Application Referral – within three (3) days of filling must send copies to:
    • Community Board
    • Borough President
    • City Council Member
    • Administrative Official who issued the determination
    • City Planning Commission

  • Must submit Proof of Service of Referral within ten (10) days of filing.

  • Hearing Notice – must send notification at least twenty (20) days before hearing to:
    • Community Board
    • Borough President
    • City Council Member
    • City Planning Commission
    • Affected Property Owners

  • Must submit Proof of Service of Hearing Notice within ten (10)  days of sending the notice.

Appeals Calendar (A) Agency Final Determination

  • Application Referral – within three (3) days of filling must send copies to:
    • Administrative Official who issued the determination
    • Subject Property Owner (if not the applicant)
    • For applications to interpret the ZR, also send to Department of Buildings and City Planning commission legal counsel

  • Must submit Proof of Service of Referral within ten (10) days of filing.

  • Hearing Notice – must send notification at least twenty (20) days before hearing to:
    • Administrative Agency
    • Subject Property Owner (if not applicant)

  • Must submit Proof of Service of Hearing Notice within ten (10)  days of sending the notice.

  • Application Referral – within three (3) days of filling must send copies to:
    • Department of Buildings
    • Community Board
    • Borough President

  • Must submit Proof of Service of Referral within ten (10) days of filing.

  • Hearing Notice – must send notification at least twenty (20) days before hearing to:
    • Department of Buildings
    • Community Board
    • Borough President

  • Must submit Proof of Service of Hearing Notice within ten (10) days of sending the notice.

    • City Planning Commission

  • Must submit Proof of Service of Hearing Notice within ten (10) days of sending the notice.

Special Order Calendar (SOC) Amendment

  • Application Referral – within three (3) days of filling must send copies to:
    • Community Board
    • Borough President
    • City Council Member
    • Administrative Official who issued the determination
    • City Planning Commission

  • Must submit Proof of Service of Referral within ten (10) days of filing.

  • Hearing Notice – must send notification at least twenty (20) days before hearing to:
    • Community Board
    • Borough President
    • City Council Member
    • City Planning Commission

  • Must submit Proof of Service of Hearing Notice within ten (10) days of sending the notice.

Special Order Calendar (SOC) Extension of Term

  • Application Referral – within three (3) days of filling must send copies to:
    • Community Board
    • Borough President
    • City Council Member
    • Administrative Official who issued the determination
    • City Planning Commission

  • Must submit Proof of Service of Referral within ten (10) days of filing.

  • Hearing Notice – must send notification at least twenty (20) days before hearing to:
    • Community Board
    • Borough President
    • City Council Member
    • City Planning Commission

  • Must submit Proof of Service of Hearing Notice within ten (10) days of sending the notice.
