      If petitioner is not the building owner, owner's consent is required as are copies of the deed and lease.

        All applicants must obtain a commercial general liability insurance policy. For specific requirements please refer to the NYC Highway Rules, linked on 'About' tab.

          Licensed professional engineer or registered architect must be hired to submit plans as per the Rules Related to Revocable Consent. Some exceptions may apply for minor improvements and structures. A request to waive the submission of plans must be requested in writing by the applicant.

            If petition is being filed in conjunction with a Department of Consumer Affairs License or a Department of Buildings Permit, proof of receipt of such licenses and permits are required. See Rules Related to Revocable Consent and inquire with the issuing agency of other related permits and licenses for more information.

              An annual rate will be charged for each year that the Revocable Consent agreement is in use, according to a formula that takes into account such factors as the type of structure/improvement, the location, and applicable minimum charges. This is in addition to the filing fees associated with the Petition.

                All documentation described above (see Rules for complete details) must be submitted with the number of required copies of the notarized Revocable Consent Petition form along with all filing fees, which vary by structure type, to the Department of Transportation, Division of Franchises, Concessions and Consents. See below or on the Petition form itself for the appropriate address.

                  The Department of Transportation will respond within 30 calendar days of receipt of a complete Petition for Revocable Consent, forward a copy to the Department of City Planning, the appropriate Community Board and elected officials and other affected City agencies and will allow 30 calendar days for all recipients to respond with either a list of objections or an approval. The petitioner then has 90 days to resolve the objections and notify the Department. If the objections have not been resolved at the end of 90 days, the petition will be assumed to be withdrawn.

                    Prior to granting any revocable consent, the Department will hold a public hearing on the terms and conditions of the proposed revocable consent agreement. The petitioner will pay for the cost to the Department of publicizing the hearing.

                      Review all rules and specifications specific to the type of structure you wish to install.

                        For a new consent petition, the petitioner must submit the original, notarized petition plus ten copies. For renewal, modification, assignment or rescission, the petitioner must submit the original plus five copies.

                          The petitioner must also submit a copy of any applicable Business Certificate/Articles of Organization document applicable to their company. For transfers or assignment of a revocable consent from one owner to another, the petitioner must also submit a copy of the Business Certificate of the assignee/transferee.

                            Scale plans designed in accordance with the specifications laid out in the Rules Related to Revocable Consent and bearing the seal of a Professional Engineer or Registered Architect licensed by the State of New York must be submitted along with photographs of the existing and proposed conditions (simulations of the proposed structure and its surroundings as they would appear after installation.) The architect or engineer must also submit an estimate of the cost of removing the structure and restoring the sidewalk/street to its original condition upon the expiration of consent.
