Administrative Law and Regulatory Litigation Division

ASSISTANT CORPORATION COUNSEL 

Salary range: $87,550 – $175,100

The Law Department is now accepting applications for the position of Assistant Corporation Counsel in the Administrative Law & Regulatory Litigation Division. The Administrative Law & Regulatory Litigation Division handles State and Federal court proceedings brought by and against the numerous City agencies that are responsible for administering and enforcing laws and regulations in the areas of public health, land use, licensing, use of the streets, transportation, public housing, building and fire codes, among others, so as to enhance the quality of life of its citizens and visitors. Some of these actions include challenges to the provisions of law themselves, while most dispute the application of a particular legal requirement in a specific context. Many cases raise constitutional claims, including First and Second Amendment challenges, challenges to various City regulations and orders on Due Process and Equal Protection grounds, among others; and many cases involve challenges that the regulations or policies at issue violate state or federal statutory provisions. The Division handles cases for over 20 different City agencies and the five City-run Pension Funds. The hired candidates will defend Article 78 proceedings and actions in state and federal courts, challenging enforcement against unlicensed cannabis establishments. In addition to our varied defensive practice, the Division brings some civil actions to obtain compliance with regulatory requirements and prosecutes code violators in New York Criminal Court to punish their non-compliance and ultimately bring about code compliance. The hired candidates will be responsible for independently handling a caseload comprised of these sorts of actions from beginning to end including preparing pleadings and affidavits after reviewing agency records and consulting with agency representatives, researching and writing memoranda of law, conducing necessary discovery, making court appearances to argue motions, and taking cases if appropriate to trial, as well as prosecuting violations and misdemeanors in Criminal Court.

All applicants must be admitted in the State of New York with at least two years of experience following graduation from an ABA approved law school. Applicants must have superior organizational, time-management, research and writing and oral advocacy skills. Applicants should have a demonstrated record of independently litigating matters in the courts. Prior regulatory or municipal law experience is preferred, but not required.

Affirmative Litigation Division

ASSISTANT CORPORATION COUNSEL, Senior Counsel/Complex Litigation    

Salary range:$132,870.00 – $182,310.00

The New York City Law Department is accepting applications from admitted attorneys with a minimum of 10 years of litigation experience for the position of Senior Counsel in the Affirmative Litigation Division. The Division represents the City in an exceptionally interesting range of federal and state cases where the City appears as plaintiff to advance key policy interests, to protect the City fisc, and to represent the City in the array of claims that arise in its operations. Division attorneys handle matters involving inter-governmental disputes, municipal corruption, public health, products liability, insurance coverage, commercial disputes, tenant protection matters, civil enforcement of the Administrative Code, and property damage claims.

The attorney in this role should possess experience in and commitment to successfully leading a litigation team in handling challenging matters, as well as independently managing a caseload. Candidates should be creative problem-solvers who take the initiative as a plaintiff to move cases to resolution. The ideal candidate also will possess excellent interpersonal, writing, and oral advocacy skills with substantial experience advising clients, negotiating settlements, and litigating in state and federal courts. INTELLECTUAL PROPERTY LITIGATION ATTORNEY, ASSISTANT CORPORATION COUNSEL 

Salary range:  $118,450-$182,310

The Affirmative Litigation Division of the New York City Law Department is accepting applications for an Intellectual Property litigator. The Intellectual Property litigator will handle both affirmative and defensive intellectual property litigation, particularly trademark litigation relating to the City’s marks and infringement of those marks. The attorney in this role also will advise City agencies, City Hall, and the City’s trademark licensing agent on matters related to copyright, trademark, and other intellectual property matters, supervise a trademark paralegal, and manage a trademark enforcement program. In addition, the attorney will work on other Affirmative Litigation commercial matters.

The Affirmative Litigation Division represents the City in a diverse and exceptionally interesting range of cases in federal and state courts and before administrative agencies where the City generally appears as plaintiff to advance key policy interests, to protect the City fisc, and to represent the City in the array of claims that arise in its operations.

Applicants must be graduates of an ABA approved law school, admitted and in good standing with the NYS bar, and be admitted, and in good standing with, or eligible for immediate admission to the federal bar. Applicants for the Intellectual Property litigator position should have extensive federal court experience and experience before the US Patent and Trademark Office and the Trademark Trial and Appeal Board, as well as general commercial litigation experience. Applicants must have a minimum of 5 years of experience in this specialized area.

Commercial and Real Estate Litigation Division

ASSISTANT CORPORATION COUNSEL, Full Time 

Salary Range: $103,000.00 - $183,310.00

The Commercial and Real Estate Litigation Division of the New York City Law Department seeks an experienced litigator to represent the City and related entities in disputes arising from their real estate dealings and property interests. The City and related entities develop significant real estate projects and lease millions of square feet of commercial real estate as landlord and tenant, and the City issues licenses to operate restaurants and other facilities on City property. In addition to defending our clients’ real estate related interests, including landlord-tenant disputes, quiet title and breach of contract actions, Division attorneys initiate affirmative cases, including RPAPL 881 proceedings, quiet title actions, encroachment and ejectment cases, and provide counseling to their clients. The attorney will also have the opportunity to handle the Division's contract cases, including delay damages and other claims under multimillion-dollar construction contracts with private companies to build or repair the City's infrastructure, contracts for critically needed goods and services, and procurement process disputes, as well as counseling City agencies regarding procurement issues, the contractual ADR process, and other matters. Ethics and Compliance Division

ASSISTANT CORPORATION COUNSEL - Special Counsel for Information Law 

Salary Range: $84,975 – $175,100

The NYC Law Department is establishing a new position of Special Counsel for Information Law in our Ethics and Compliance Division. The attorney in this role will act as the agency’s Records Access Officer and be responsible for the Law Department’s compliance with the New York State Freedom of Information Law (FOIL) and the New York City Identifying Information Law. The Special Counsel will: receive, track, and interpret requests for information made to the Law Department pursuant to FOIL; interact with staff throughout the Department to locate, retrieve, and review documents that may be responsive to the requests; analyze how much of the information must be disclosed to the requestor and whether any may be withheld; and issue determinations granting or denying requests to requesters. The Special Counsel will also assist the Law Department Records Appeals Officer with FOIL appeal determinations and advise the Department’s General Litigation Division on FOIL-related Article 78 defenses. They will also advise and train City clients on the FOIL law, practice, and relevant legal updates.

In addition, the Special Counsel will have the responsibilities of an “Agency Privacy Officer” (“APO”) under the Identifying Information Law. These include, among other things: overseeing day-to-day agency compliance by all divisions of the Department (advising staff on privacy issues, approving projects/contracts that involve collecting or disclosing identifying information); quarterly reporting to the City’s Chief Privacy Officer, drafting the agency’s biennial Agency Report on collections, disclosures, and retentions of identifying information, and investigating privacy incidents within the Department or by third-party contractors. The APO also serves as a member of the Citywide Privacy Protection Committee, organized and managed by the City’s Office of Information Privacy.

Applicants must be graduates of an ABA approved law school and admitted and in good standing with the New York State Bar with at least one year of legal experience after law school. Experience with litigation and/or compliance with FOIL requests is preferred, but not required. Attorneys with more than five years of legal experience after law school will be considered for a Senior Counsel position in the division.

The Ethics & Compliance Division has counseling and ligation adjacent roles and responsibilities. The Division’s counseling role involves advising City Hall, elected officials, and Law Department and other City agency officers and employees on a variety of topics, including legal ethics, conflicts, privileges, federal grants, Medicare compliance, and outside employment. Division attorneys also conduct internal and external trainings in these areas. The Division investigates and reports on whistleblower and employment disciplinary matters and serves as a liaison to the Conflicts of Interest Board on Chapter 68 inquiries. Division attorneys also represent City attorneys and Assistant District Attorneys before the attorney grievance committees. In addition, they review and provide guidance on sanctions and representation matters, including conducting representation interviews.

Executive Division

ASSISTANT EEO OFFICER

Salary: $118,450 – $154,500

The New York City Law Department is accepting applications from admitted attorneys for an Assistant EEO Officer position in the Executive Division. The individual in this role will report directly to the Chief Diversity and EEO Officer and/or designee. The individual in this role will report all DEI and Compliance activities and all EEO investigations and confidential matters to the Chief Diversity and EEO Officer and/or designee. The individual in this role will assist with reasonable accommodation request and various EEO and DEI trainings.

Essential Duties and Responsibilities include, but are not limited to the following:

- Conduct regular internal and external EEO investigations and inquiries.
- Prepare Diversity & EEO Quarterly Reports, Memos and Monthly Reports.
- Assist with EEO related trainings for Law Department staff. This includes PowerPoint presentations and in-person trainings at various Law Department locations throughout the 5 boroughs, as needed.

Family Court Division

ASSISTANT CORPORATION COUNSEL - Interstate Child Support Unit

Salary Range: $97,850 – $175,100

The Family Court Division is currently seeking applications from admitted attorneys with a minimum of two years litigation experience for the position of Assistant Corporation Counsel in the Division’s Interstate Child Support Unit (ICSU) in its Brooklyn, Bronx, Manhattan, and Queens offices. Attorneys assigned to the unit litigate child support cases in the New York State Family Court. Attorneys appear primarily before support magistrates and Family Court judges.

The attorney is responsible for the preparation and presentation of petitions to establish paternity and child support as well as appearing on and defending applications for modification of previously established orders. The attorney will also prepare and present enforcement matters, file and respond to motions, file objections and rebuttals, conduct discovery, including document production and inspection, prepare memorandum of law, interviews clients and witnesses, negotiate settlements and conduct hearings and trials. Attorneys assigned to the unit may be required to work on cases and other responsibilities in the evening and weekend hours.

ASSISTANT CORPORATION COUNSEL - Advanced Litigation and Major Case Unit

Salary Range: $87,550 – $175,100

The New York City Law Department is accepting applications from admitted attorneys with a minimum of four years litigation experience for the position of Assistant Corporation Counsel (ACC) in the Family Court Division’s Advanced Litigation and Major Case Unit. Successful candidates will receive extensive training and develop an expertise in the investigation and prosecution of firearms cases. Litigation Support Division

ASSISTANT CORPORATION COUNSEL, Litigation Support Discovery Technology Attorney

The NYC Law Department is accepting applications from admitted attorneys for the Agency-Based Discovery unit of the Litigation Support Division.
