ASSISTANT CORPORATION COUNSEL
Salary range: $87,550 – $175,100
The Law Department is now accepting applications for the position of Assistant Corporation Counsel in the Administrative Law & Regulatory Litigation Division. The Administrative Law & Regulatory Litigation Division handles State and Federal court proceedings brought by and against the numerous City agencies that are responsible for administering and enforcing laws and regulations in the areas of public health, land use, licensing, use of the streets, transportation, public housing, building and fire codes, among others, so as to enhance the quality of life of its citizens and visitors. Some of these actions include challenges to the provisions of law themselves, while most dispute the application of a particular legal requirement in a specific context. Many cases raise constitutional claims, including First and Second Amendment challenges, challenges to various City regulations and orders on Due Process and Equal Protection grounds, among others; and many cases involve challenges that the regulations or policies at issue violate state or federal statutory provisions. The Division handles cases for over 20 different City agencies and the five City-run Pension Funds. The hired candidates will defend Article 78 proceedings and actions in state and federal courts, challenging enforcement against unlicensed cannabis establishments. In addition to our varied defensive practice, the Division brings some civil actions to obtain compliance with regulatory requirements and prosecutes code violators in New York Criminal Court to punish their non-compliance and ultimately bring about code compliance. The hired candidates will be responsible for independently handling a caseload comprised of these sorts of actions from beginning to end including preparing pleadings and affidavits after reviewing agency records and consulting with agency representatives, researching and writing memoranda of law, conducing necessary discovery, making court appearances to argue motions, and taking cases if appropriate to trial, as well as prosecuting violations and misdemeanors in Criminal Court.
All applicants must be admitted in the State of New York with at least two years of experience following graduation from an ABA approved law school. Applicants must have superior organizational, time-management, research and writing and oral advocacy skills. Applicants should have a demonstrated record of independently litigating matters in the courts. Prior regulatory or municipal law experience is preferred, but not required.

ASSISTANT CORPORATION COUNSEL, Senior Counsel/Complex Litigation
Salary range: $132,870 – $182,310
The New York City Law Department is accepting applications from admitted attorneys with a minimum of 10 years of litigation experience for the position of Senior Counsel in the Affirmative Litigation Division. The Division represents the City in an exceptionally interesting range of federal and state cases where the City appears as plaintiff to advance key policy interests, to protect the City fisc, and to represent the City in the array of claims that arise in its operations. ASSISTANT CORPORATION COUNSEL

ASSISTANT CORPORATION COUNSEL - Special Counsel for Information Law
Salary Range: $84,975 – $175,100
The NYC Law Department is establishing a new position of Special Counsel for Information Law in our Ethics and Compliance Division. The attorney in this role will act as the agency’s Records Access Officer and be responsible for the Law Department’s compliance with the New York State Freedom of Information Law (FOIL) and the New York City Identifying Information Law. The Special Counsel will: receive, track, and interpret requests for information made to the Law Department pursuant to FOIL; interact with staff throughout the Department to locate, retrieve, and review documents that may be responsive to the requests; analyze how much of the information must be disclosed to the requestor and whether any may be withheld; and issue determinations granting or denying requests to requesters. The Special Counsel will also assist the Law Department Records Appeals Officer with FOIL appeal determinations and advise the Department’s General Litigation Division on FOIL-related Article 78 defenses. They will also advise and train City clients on the FOIL law, practice, and relevant legal updates.
In addition, the Special Counsel will have the responsibilities of an “Agency Privacy Officer” (“APO”) under the Identifying Information Law. These include, among other things: overseeing day-to-day agency compliance by all divisions of the Department (advising staff on privacy issues, approving projects/contracts that involve collecting or disclosing identifying information); quarterly reporting to the City’s Chief Privacy Officer, drafting the agency’s biennial Agency Report on collections, disclosures, and retentions of identifying information, and investigating privacy incidents within the Department or by third-party contractors. The APO also serves as a member of the Citywide Privacy Protection Committee, organized and managed by the City’s Office of Information Privacy.

The Ethics & Compliance Division has counseling and ligation adjacent roles and responsibilities. The Division’s counseling role involves advising City Hall, elected officials, and Law Department and other City agency officers and employees on a variety of topics, including legal ethics, conflicts, privileges, federal grants, Medicare compliance, and outside employment. Division attorneys also conduct internal and external trainings in these areas. SENIOR COUNSEL, MAYOR'S OFFICE OF SPECIAL ENFORCEMENT
Salary range: $92,700–$125,660
The Mayor's Office of Special Enforcement (OSE) is responsible for coordinating enforcement efforts across City agencies to address complex quality of life issues, including illegal short-term rentals, adult use and illegal massage locations, and emerging issues or special projects. OSE ensures that these enforcement efforts (including inspections, litigation, outreach, and education) are leveraged across all five boroughs to address dangerous conditions at properties that require a coordinated multi-agency response.
Assistant Corporation Counsels are assigned as agency partners to work in the Office of Special Enforcement (OSE), which is within the Mayor’s Office of Criminal Justice (MOCJ). The ACCs’ duties range from providing counsel on investigative and policy issues to serving as lead litigator in complex civil litigation, and include the following responsibilities: Drafts litigation documents, including memos, correspondence, pleadings, motions, and discovery requests and responses for civil enforcement actions. Consults with City inspectors, investigators, and other law enforcement personnel to prepare affidavits in support of motions and applications. Appears in Supreme Court or other courts for arguments, hearings, and conferences concerning substantive and procedural motions, as well as pre-trial discovery depositions and disputes and case settlement discussions. Negotiates resolutions of civil actions with defense counsels and then drafts stipulations of settlement. Ensures that injunctive relief provisions are complied with and that all necessary settlement payments are made. Provides legal counsel to OSE Inspection Teams regarding administrative enforcement issues related to inspections of buildings and structures with suspected safety concerns. Supports team investigations and enforcement actions by drafting and filing administrative access warrants and subpoenas. In preparation for affirmative litigation, reviews and compiles complaints, administrative records from various City agencies and departments, inspection reports, notices of violations, administrative and judicial decisions regarding prior enforcement, arrest reports, and disposition records. Assists in prosecution of violations before administrative hearing officers, prepares appeals of administrative decisions, and assists in defensive litigation against the City stemming from OSE enforcement actions. Prepares and responds to FOIL requests timely.

Minimum Qualifications:

ASSISTANT CORPORATION COUNSEL
Salary range: $97,850/$97,850-$118,450
The New York City Law Department is seeking an attorney with two to five years of experience to serve as an in-house counsel to the City and related entities that issue municipal bonds and facilitate loans with respect to corporate governance, litigation audits, federal disclosure issues and documentation for municipal bonds and other complex debt instruments. New York City, one of the largest municipal bonds issuers in the country, issues billions of dollars of debt through general obligation bonds and the bonds of City-related authorities and local development corporations. The bond proceeds fund City capital projects in a variety of areas, including education, transportation, economic development, and environmental protection. The Division also performs legal work related to the corporate governance activities of said authorities and local development corporations and the New York City Water Board, produces litigation letters and generally assists with procedures related to their annual financial audits and is responsible for compliance with federal regulations that require the public disclosure of financial information material to investors.
The Municipal Finance attorney responsibilities will include but are not limited to: Assisting the City and related entities in complying with federal continuing disclosure requirements and practices over the life of each bond issue with respect to the City and its related issuers to ensure consistency with municipal market and regulatory expectations. Attending all local development corporations board meetings, counseling the board members on all corporate governance and disclosure matters related to federal, state and local regulatory compliance. Coordinating with City agencies, including State and City Comptroller in providing certain due diligence, such as reporting on financial information in accordance with the SEC and other federal, state and/or local finance laws. Working closely with City agencies to help the City and its related issuers develop post-issuance compliance policies and procedures in accordance with securities laws. Tracking, reviewing, researching, analyzing and filing all ratings of City bonds, underwriters and other City related bond issuers through the Electronic Municipal Market Access (EMMA) portal. Conducting due diligence regarding material compliance with the City and its related issuers offering documents to determine whether voluntary disclosure updates are necessary. Assisting the City and its related issuers in review and analysis of, and preparation of comments on proposed laws, regulations and rules relating to the City’s financings, including but not limited to MSRB and SEC amendments. Preparing and reviewing documents related to the issuance of debt instruments including public offering documents. Assisting Division attorneys in the management and oversight of certain City facilitated loan programs. Duties will also involve producing transaction documents under strict deadlines and working with senior New York City policymakers.

ASSISTANT CORPORATION COUNSEL

The New York City Law Department Special Federal Litigation Division is seeking an attorney to serve as an Assistant Corporation Counsel in one of the following positions:
General ACC
The Assistant Corporation Counsel would defend the City and its officials in civil rights cases brought in federal court in which police, district attorney or correction officer misconduct is alleged by those who believe their constitutional rights were violated in the course of an arrest and subsequent prosecution, or on account of events in City jails. As part of their duties, the Assistant Corporation Counsel can expect to defend the City and members of law enforcement in cases brought by litigants who have had convictions reversed, those challenging the constitutionality of police actions during the 2020 Spring/Summer demonstrations and Covid-19 curfew enforcement, as well as class actions on various constitutional claims.
The hired attorney for these positions will handle a caseload from inception through resolution whether by motion practice, settlement, or trial. Attorneys conduct initial investigations to determine if representation is appropriate, answer the complaint, appear at court conferences, engage in extensive discovery (paper and electronic), take and defend depositions, draft dispositive motions, conduct settlement negotiations, and, when appropriate, take cases to trial in federal court.
Federal Monitorship ACC
The Assistant Corporation Counsel would be a part of a team that provides legal counsel to NYPD in connection with the continued development, implementation, and compliance with City’s relationship with a federal Monitor appointed by the Court to oversee policing reforms by NYPD. The New York City Law Department’s Special Federal Litigation Division is seeking attorneys to serve as Assistant Corporation Counsels. The Assistant Corporation Counsel would defend the City and its officials in civil rights cases brought in federal court in which police, district attorney, or correction officer misconduct is alleged by those who believe their constitutional rights were violated in the course of an arrest and subsequent prosecution, or on account of events in City jails.
