Worker Cooperative Reports

Local Law 22 of 2015 (LL 22) places reporting requirements on MOCS and the Department of Small Business Services (SBS) on the status of worker cooperative businesses in the City.

Under LL 22, a worker cooperative is a business where the workers are represented on the Board of Directors and the workers control the majority of the voting stock. If the business is held in a trust that controls the majority of the voting stock, the trustees are elected by the workers. It also includes any corporation organized under the NYS Business Corporation Law that has elected to be governed as a worker cooperative under the provisions of the NYS Cooperative Corporations Law, by so stating in its certificate of incorporation or amendments to its certificate of incorporation.

LL 22 requires MOCS to report annually on City contracts with corporations that have self-identified as worker cooperatives through the Payee Information Portal (PIP) or through SBS's customer relationship management system. The report includes the following:

1. the number and total dollar value of City contracts awarded to worker cooperatives, disaggregated by agency and type of business;

2. the number and total dollar value of all City contracts, disaggregated by agency and type of business; and

3. the percentage of City contracts awarded to worker cooperatives, disaggregated by agency and type of business.
