Fire Code Rules ›

The Fire Department implements the New York City Fire Code by adopting rules. A rule is an agency regulation that has the force of law. All of the Fire Department rules are compiled in Title 3 of the Rules of the City of New York. Before any Fire Department Rule is adopted, it is posted on the NYC Rules website, and the public is given an opportunity to review it and submit comments. The Fire Department also conducts a public hearing at Fire Department Headquarters. Final Department rules are published by NYC Rules, and generally take effect 30 days after publication


Adopted Rules (2018-2023)

2023

Amendments to Fire Department rules 3 RCNY §§ 104-02 (entitled “Professional Certification of Fire Alarm System Installations”), 104‑04 (entitled “Certification of Corrected Defects in Fire Alarm System Installations”) and 105‑01 (entitled “Approval of Fire Alarm System Installations”). These rules will take effect on May 1, 2023.

Amendments to Fire Department rule 3 RCNY § 4900-02 "Schedule of Charges for Fire Department Ambulance Treatment and Transport Services". This rule will take effect on May 1, 2023.

2022

Consolidation of Administrative Code Provisions For Enforcement Purposes
Fire Department Amended Rule 3 RCNY 109-02 Consolidation of Administrative Code Provisions For Enforcement Purposes will take effect on April 21, 2022.


2020

Schedule of Charges for Fire Department Ambulance Treatment and Transport Services
Fire Department Amended Rule 3 RCNY 4900-02 Schedule of Charges for Fire Department Ambulance Treatment and Transport Services will take effect on January 1, 2021.

Fire and Emergency Preparedness Guide, Checklist and Notices
Fire Department Amended Rule 3 RCNY 401-06 Fire and Emergency Preparedness Guide, Checklist and Notices will take effect on January 1, 2021.

Certification of Corrected Defects in Fire Alarm System Installations:
Fire Department Rule 3 RCNY 104-04 Certification of Corrected Defects in Fire Alarm System Installations will take effect on December 1, 2020.

Non-Tobacco Hookah Establishments:
Fire Department rule 3 RCNY 310-03 Non-Tobacco Hookah Establishments will take effect on July 1, 2020.


2019

Emergency Preparedness/Evacuation Planning Checklist & Close The Door Notice:
Fire Department rule 3 RCNY 401-06 Fire and Emergency Preparedness Guide, Checklist and Notices took effect on November 15, 2019.

Outdoor Stationary Storage Battery Systems:
Fire Department rule 3 RCNY 608-01 Outdoor Stationary Storage Battery Systems took effect on October 1, 2019.

New and Amended Fees:
Fire Department rule 3 RCNY 4601-01 New and Amended Fees took effect on June 1, 2019.

Outdated BSA Rules and Reorganization of Building Design Rules:
Repeal of Outdated BSA Rules and Reorganization of Building Design Rules took effect on May 5, 2019.

Fire and Non-Fire Emergency Drills:
Fire Department rule 3 RCNY 401-07 Fire and Non-Fire Emergency Drills took effect on January 1, 2019.


2018

Apartment Building Emergency Preparedness Rule:
Fire Department rule 3 RCNY 408-02 Residential Fire Safety Guides and Notices was repealed effective October 1, 2018. It was superseded by 3 RCNY 401-06 Fire and Emergency Preparedness Guide, Checklist and Notices. (See 2019 amendments)

Commercial Cooking/Portable Fire Extinguisher Rule:
Fire Department rule 3 RCNY 115-02 Issuance of Proof of Compliance to Company Certificate Holders took effect on June 1, 2018.
