MAYOR BLOOMBERG ANNOUNCES TENTATIVE AGREEMENT WITH THE CAPTAINS’ ENDOWMENT ASSOCIATION

Agreement for High Ranking Police Officials Provides Over 40% in Increased Compensation;

By End of Historic 8-Year Deal Maximum Compensation Will Be $165,000

Mayor Michael R. Bloomberg and John F. Driscoll, President of the Captains’ Endowment Association (CEA), announced that a tentative contract settlement has been reached with the Captains’ Endowment Association on a collective bargaining agreement covering the period from November 1, 2003 through March 31, 2012.  The agreement, which is subject to ratification, covers over 700 officers in the highest ranks in the Police Department including: Captain; Captain detailed as Deputy Inspector, Inspector and Deputy Chief; Police Surgeon; Surgeon; Surgeon detailed as Deputy Chief Surgeon; and Chief Surgeon. This contract settlement comports with the economic parameters of all of the other uniformed contracts settled to date. 

“The members of the Captains’ Endowment Association, from Captain to Chief, make up some of the Department’s most vitally important ranks,” said Mayor Bloomberg. “These officers contributed immensely to our City’s successes in achieving historically low levels of crime. The CEA showed they could roll up their sleeves, and with creativity, resourcefulness, and hard work, negotiate a collective bargaining agreement the old-fashioned way – across the bargaining table.”

“Captains in the New York City Police Department shoulder responsibilities that exceed those of most police chiefs across the country,” said Police Commissioner Raymond W. Kelly. “They are the backbone of the Police Department’s management corps, and they have helped drive crime down to record lows. They more than deserve the increased compensation reflected in this new agreement.”

“This was by far the most difficult round of bargaining, but I feel that we have reached a satisfactory contract for my members and for the City of New York, now and into the future,” said CEA President Driscoll. “I extend my deepest gratitude to the Mayor, Deputy Mayor Edward Skyler, Office of Labor Relations Commissioner Hanley and Police Commissioner Kelly.”

The principal features of the settlement are:

• 5% effective November 1, 2003
• 5%, compounded, effective November 1, 2004
• 3%, compounded, effective February 1, 2006
• 3.15%, compounded, effective February 1, 2007
• 4%, compounded, effective February 1, 2008
• 4%, compounded, effective February 1, 2009
• 4%, compounded, effective April 1, 2010
• 4%, compounded, effective April 1, 2011

At the end of this contract, a Captain’s basic maximum salary will be $141,933 as compared to the current amount of $103,577. With longevity pay, holiday pay, night shift differential and other additions total compensation will be approximately $165,000. The total increase in compensation is approximately 40%, including a compounded wage increase of over 37%.  This contract includes extensions totaling five months.

Additional Compensation Funds

Effective March 1, 2009, an innovative addition to the annuity fund, first introduced in the Lieutenants settlement in July 2006, will be established. There will be a $168 increase per year per member in the annuity fund contribution and the establishment of a $168 per year Savings Incentive Plan on behalf of each active member in the bargaining unit who is both a member of the 457 Plan and also who invests a minimum of one percent of salary per year.

Effective October 31, 2009, there will be a $100 per year increase in the City’s contribution to the welfare funds for active members and retirees.

Effective May 1, 2011, there will be a $1,500 increase on each step of the longevity schedule, a $380 per year annuity fund increase, and an additional $380 per year in the Savings Incentive Plan, bringing the City’s total contribution on behalf of each active member in the bargaining unit who is both a part of the 457 Plan and who invests a minimum of one percent of salary per year to $548 per year.


Productivity

The PBA impasse award of June 2005 created the economic parameters for the first two years of bargaining covered under this agreement and thus necessitated the funding mechanisms of a reduced salary schedule and fewer annual leave days for new promotees. Effective March 1, 2009, there will be full restoration of the reduced salary schedule for new promotees and full restoration of the six day reduction in annual leave days for new promotees.  The parties applied funding available in the settlement to address this specific area of the contract.

Those newly promoted to the rank of Captain will also work a duty schedule consisting of 261 nine-hour tours for the first five years of service. There will be a $650 reduction in annuity contributions for new promotees in the rank of Captain during the first five years after promotion. New promotees to the rank of Captain will accrue six fewer annual leave days per year for the first five years after promotion.

In addition, effective September 1, 2007, the following provisions will apply to all members of the unit for the entire term of the agreement: members of the unit will perform one of the two annual “Range Days” required for firearms qualification on a regularly scheduled day off between Monday and Friday without compensation.  Any other training conducted on that day will also be without compensation. The Police Department will have the right to reschedule tours of duty without additional compensation for all members in the bargaining unit. 

Other Provisions

The current number of budgeted positions for Captains detailed or assigned to the ranks of Deputy Inspector, Inspector or Deputy Chief will be increased to 4.92% of the current bargaining unit.

The Mayor thanked Deputy Mayor Edward Skyler, Police Commissioner Raymond W. Kelly, CEA President John Driscoll and his Committee, Labor Commissioner James F. Hanley and First Deputy Commissioner Pamela S. Silverblatt and their team, and Budget Director Mark Page and his staff for their efforts in reaching this agreement.
