Program for Undocumented Spouses of U.S. Citizens

On June 18th, 2024, the federal government announced additional protections for undocumented spouses of U.S. citizens.

This new process will allow certain undocumented spouses and children of U.S. citizens to apply for a green card without leaving the United States.

To qualify, individuals must have been

  • Living in the U.S. for 10 or more years as of June 17, 2024, and
  • Be legally married to a U.S. citizen or be a qualifying child of someone married to a U.S. citizen.

Those who qualify will be given a work permit for 3 years, during which they will be able to apply for lawful permanent residence.

How to Prepare Your Documents

Immigration is not accepting applications at this time and any application submitted will be automatically rejected. We anticipate applications will be accepted later in the summer or early fall.

Individuals who think they qualify can gather their documents while we wait for further instructions, including:

  • Identity documents showing your photo, name, and date of birth like a passport or a birth certificate (if neither is available, alternative documentation should be discussed with an attorney).
  • Proof you have been in the United States for 10 years as of June 17, 2024, like bank statements, housing agreements, apartment leases, school records, medical records, pay stubs, letters of employment, and federal income tax returns.
  • Proof of your marriage to a U.S. Citizen, such as a marriage certificate, marriage license, birth certificates of children, joint bank statements, and pictures of you and your spouse.
