Existing Building Code

The New York City Existing Building Code (EBC) was introduced by the New York City Council on June 11, 2025. The proposed legislation, known as Intro 1321-2025, governs the alteration and maintenance of existing buildings, amends the Administrative Code of the City of New York, and repeals the 1968 Building Code.

Upcoming Effective Dates of the Existing Building Code

The effective date of Intro 1321-2025 will be the same day as the companion legislation that amends and aligns the Construction Codes with the New York City Existing Building Code.

Current Existing Building Regulations

Until the EBC becomes effective,  the alteration and maintenance of existing buildings will continue to be regulated by the Administrative Code of the City of New York and the 2022 New York City Construction Codes. At the option of the owner, work on prior code buildings can be performed in accordance with the requirement of the 1968 Building Code as described in Article 101 of the Administrative Code of the City of New York.
