SECOND ADULT VIDEO STORE ORDERED TO CLOSE IN LESS THAN ONE WEEK -- VIOLATES MAYOR GIULIANI'S ADULT-USE ZONING MORATORIUM OPERATING
WITHIN 500 FEET OF A RESIDENTIAL AREA
Mayor Rudolph W. Giuliani announced today that the Department of Buildings has issued violations against a second adult-use establishment in less than one week. The location, Mikee's Mufflers on 4028 Boston Road in the Bronx, violated the adult-use zoning requirements that prohibit adult-use operation within 500 feet of a residential or school district. It also violated its Certificate of Occupancy as a gas station, operating with an "Adult Films and Entertainment XXXXX" sign. This was the second first new adult-use business to open illegally since the moratorium went into effect.
The Mayor reiterated his commitment to keep residential and school districts free of sex shops and X-rated video stores.
"This adult use establishment was promptly served two violations: One that spelled out a Certificate of Occupancy to operate only as a garage or gas station and a second for selling triple-X rated films within 500 feet of a residential neighborhood and school," the Mayor said. "This is the second closure in less than a week of an adult-use establishment and serves as a stern reminder to the new establishments that illegal operation of such establishments will not be tolerated."
Following notification that there are explicit signs in the window, the Mayor said, "As I said before sex shops destroy neighborhoods. Children walk by signs "Joys Are Us" on their way to school and a school is just a few thousand feet away. This flies in the face of the zoning requirements enacted to protect neighborhoods against these corrosive intrusions."
The City Planning Commission approved amendments to the Zoning Resolution governing adult entertainment establishments. The resolution took effect on October 25, 1995. The amendments are applicable to adult book and video stores, which often provide booths for on-premises viewing of video ("peep shows"); adult eating and drinking establishments, such as topless or nude clubs; and adult theaters, which may offer movies or live entertainment. When the plan is fully implemented, only 29 of the 177 sex shops that existed in 1993 will be permitted to remain open.
