IMPORTANT MESSAGE, PLEASE READ:
NYC Office of Nightlife
September 28, 2021

Dear Bar/Restaurant Owner,

NYC Open Restaurant structures must comply with the Americans with Disabilities Act (ADA). The NYC Department of Transportation has determined that your Open Restaurant may not comply with the ADA because it either lacks (i) a firm, slip-resistant platform that is leveled with the sidewalk OR (ii) if you do not have a platform, a curb ramp connecting the sidewalk with street level.

You may be subject to a penalty unless you
promptly correct the problem.

You may avoid a penalty by submitting photos and written evidence that you comply to the Office of Nightlife before FRIDAY, OCTOBER 8, 2021, via email to: nightlife@media.nyc.gov

Instructions: Specifically, you should send photos and a statement that shows that your Open Restaurant structure has either:
  • A firm, slip-resistant platform that is the same height as the sidewalk.
OR
  • An ADA-compliant curb ramp connecting the sidewalk with street level. See photo examples below.

For details about the applicable ADA requirements, review the sections entitled “Changes in Level,” “Platform,” “Ramp Requirements,” and “Alternative Curb Ramp” in the Mayor's Office for People with Disabilities OpenRestaurants Accessibility Requirements (pdf).

Please contact the Office of Nightlife with any questions or concerns, at: nightlife@media.nyc.gov
Sincerely,

Ariel Palitz
Senior Executive Director
