Thank you for downloading the New York City Parking Ticket Pay or Dispute App App. This App allows you to search, pay or dispute your parking ticket, or see your payment history. The following terms and conditions govern the use of this app as well as the services accessed from it. Please read these terms and conditions carefully.

General Information
It is anticipated that this App will be available 24 hours a day, 7 days a week, except for scheduled maintenance periods. However, unexpected outages that prevent users from making a payment on this App may occur. Enter your ticket information or license plate number and you can find out how much you owe and whether or not your ticket is in judgment. These Terms and Conditions govern your use of this App and constitute an agreement (“Agreement”) between the City of New York (“City”) and you, the User, concerning this Parking Ticket Payments Application (the “App”). By using the App and clicking “I agree,” you are consenting to these Terms and Conditions. If you access this App from any non-U.S.territory, please note you do so at your own risk and are responsible for compliance with any local laws. "Robots," "spiders," malware, malicious codes or programs, bots, scraping, trolling, automated programs, and any use that adversely affects site or server bandwidth are prohibited from using this App.

Definitions
In this Agreement, the word "Account" is the bank account or the credit card or debit card account you designate as the payment account for the Electronic Bill Payment Service (as described below). The words "you" and "your" refer to the user of the App. If such user is an authorized agent of a disclosed principal in whose name the Account has been established, then "you" and "your" refer to such principal. The words "we," "our" and "us" refer to The City of New York (the "City"). "Financial Institution" refers to the bank or card issuer, which holds or issues your Account. "Agreement" refers to the terms and conditions stated herein, or as amended by us from time to time. "Business Days" means Monday through Friday, except for City holidays.

Privacy of Information
By agreeing to these Terms and Conditions, you acknowledge that we will receive certain personal information when you use this App, and that you are voluntarily providing this information to us. We will not rent, sell or otherwise make available to any third party any information that identifies you or payments you make through this App, other than to process your payment or use for the purpose to contacting you or notifying you for the transactions or comply with applicable law, rule or regulation. To the extent a parking ticket contains information that is not considered confidential, such information may be posted or available on this App as part of the billing information. This App will NEVER ask for anyone’s social security number. If we ever decide to use e-mail addresses or telephone numbers (via text messages) to confirm receipt of your submission, provide a payment receipt, or notify you of a pending parking ticket, we will first ask your permission. Security
To process your payment securely, we use Secure Sockets Layer (SSL) and/or Transportation Layer Security (TLS), security protocols that provide data encryption, server authentication, and message integrity for connections to the Internet, to ensure that account numbers and personal data you provide by using this App are not transmitted over the Internet unencrypted and cannot be viewed by unauthorized individuals.

Using the Credit/Debit Card and Electronic Check Payment Service (e-Check)
An Internet-based service allows you to make payments to the City via the Internet using your credit or debit card, bank account, e-check, Apple Pay, Android Pay, or any other payment method that the City may use. In activating this service you instruct the City or its authorized agent to debit or charge your account which allows your payment to be forwarded to us, based on the payment instructions you provide on the App, subject to these Terms and Conditions. If you choose not to accept these Terms and Conditions, you will not be able to make a payment on this site and none of the personal information that you provide on this App will be transmitted or retained by the City of New York.

In order to use this App, you must complete all requested information. If you are concerned about your privacy, then please see our Privacy Policy. You must designate an Account at a Financial Institution, which will be debited in order to forward the payment to us. You must be a person in whose name such Account has been established or a person authorized to use or draw against such Account.

You authorize The City of New York or its authorized agent to initiate debit entries to (i.e., charges against) your Account in the amounts you specify and to initiate any debit or credit entries or reversals, as the case may be, to your Account as may be necessary to correct any error in a payment or transfer. Your Account will show separate transactions for the payment to us. Once you complete a transaction on this App, your authorization to debit or charge your Account for this specific payment shall remain in full force. In order for you to make the payment, we will electronically order our Financial Institution to debit your Account to execute a transfer of your funds in the amount you instructed.
Your payment is considered accepted when you receive an online confirmation. Payments received before 6 PM will be provisionally credited to your account on the date you make your payment. If your payment is received after 6 PM, on a weekend, or a holiday, it will be provisionally credited to your account on the next business day. It will not be considered final until it is deemed settled by your financial institution. If you make your payment with a MasterCard and Visa debit or credit cards, we will receive funds two business days after the date on which you execute payment. If you make your payment with an American Express or Discover credit or debit card, we will receive funds three business days after the date on which you execute payment. For payments made by eCheck we will receive funds within two business days after the date on which you execute payment.

In Case of Errors or Questions about Your Payment
For questions about payments made through this App, please contact us via https://www1.nyc.gov/site/finance/about/contact-by-email/contact-us-general-correspondence.page. For questions about your bill, invoice, the fulfillment of any transaction, or any question not related to your payment transaction, please contact the issuing Agency. You agree to contact us as soon as possible if you believe that an error has occurred, or if there has been unauthorized use of your account. When you contact us, please be prepared to provide your name and receipt number.

Limits on Use

1. By using this App, you represent that you are at least 18 years old or have reached the age of majority in your jurisdiction. If you are not using the App on behalf of an entity and you are under 18 years old or have not reached the age of majority in your jurisdiction, your parent or legal guardian must use the App on your behalf and accept these Terms.
2. You must be a person authorized to make a payment using the credit or debit card or bank account provided to us on this App. Payment must be made in U.S. dollars. You agree not to use the CityPay App in an amount that will exceed the funds or available credit line in your Account. If you do, we have no obligation to complete the transaction and you agree that we may debit your Account for our returned item fee or other similar fee.
3. Your use of your Account may be limited by your agreement with your Financial Institution and by applicable law. We are not responsible for not completing a transaction as a result of any such limit on your Account, and we are not responsible if your Financial Institution fails to honor any debit against your Account. At our sole discretion, we may refuse to complete any transaction, which we have reason to believe is not made by you, may violate any law, rule or regulation, or if we have reasonable cause not to honor it.
4. If you are accepting on behalf of the User (be it your employer or another entity), you represent and warrant that: (i) you have full legal authority to bind your employer, or the other applicable entity, to these Terms; (ii) you have read and understand this Agreement; and (iii) you agree, on behalf of the party that you represent, to this Agreement. If you don’t have the legal authority to bind your employer or the other applicable entity, please do not tap “Accept”.
5. You cannot use the App:
   1. to commit a criminal offense or to encourage others to engage in any conduct which would constitute a criminal offense;
   2. in a way to give rise to civil liability or encourage others to engage in any conduct which would give rise to civil liability;
   3. to sell, resell, lease (or engage in a functionally equivalent transaction concerning) the App;
   4. to impersonate other parties or entities;
   5. to upload any content that contains a software virus, "Trojan Horse" or any other computer code, files, or programs that may alter, damage, or interrupt the functionality of the App or City government infrastructure;
   6. to impair anyone else’s use of the App or of the wireless network via which you have downloaded the App;
   7. to obtain (or try to obtain) any data from the App except the data that the City intends to make available to the User; or
   8. to modify, reverse engineer, decompile, or disassemble the App (or attempt to do so), whether in whole or in part, create any derivative works from or of the App, or bypass, modify, defeat, or tamper with or circumvent any of the functions or protections of the App or any mechanisms operatively linked to the App, for example, by augmenting or substituting any digital rights management functionality.

Service Operation and Equipment
You may only access the App with the device(s) by which you downloaded the App (each an “Authorized Device”). The download on each Authorized Device shall create a separate Agreement. You acknowledge that you may incur charges from the wireless carrier for your Authorized Device(s) and agree that the City will not be responsible for paying or reimbursing you for such charges.

Consent for Internet-Based or Wireless Services
The App may connect to computer systems over an Internet-based wireless network. In some cases, the User will not receive a separate notice when it connects. Using the App operates as your consent to the transmission of standard device information (including but not limited to technical information about its Authorized Device, system and application software, and peripherals) for Internet-based or wireless services.

Intellectual Property
Service marks and trademarks contained in or displayed on the App, and the contents of linked sites operated by the City or third parties, are the property of their respective owners. All other design, information, text, graphics, images, pages, interfaces, links, software, and other items and materials contained in or displayed on the App, and the selection and arrangements thereof, are the property of the City of New York. All rights are reserved. Except as expressly set forth herein, this Agreement does not grant either party any rights, implied or otherwise, to the other's content or any of the other's intellectual property.

User Support
The City does not offer user support for the App.

Third-Party Terms

1. You agree under this Agreement to abide by any usage rules set forth in the terms of service from the online application store from which you downloaded this App.
2. The platform on which you run this App may contain additional terms, codes of conduct, or guidelines that govern your use of that platform (“Third-Party Terms”). You agree under this Agreement to abide by the Third-Party Terms.
3. Notwithstanding the previous paragraph, any dealings between you and such a third party are solely between you and that third party. The City does not endorse and is not responsible or liable for any aspect of any such dealings.
4. Nothing in the Third-Party Terms increases the City’s liability or changes your relationship with the City.
5. Please review the privacy controls provided by the third-party’s platform and be aware that those controls may affect how you share your personal information when using that platform.

Communications/Verifications
Communications to us via this App shall in no way be deemed to constitute legal or official notice to the City of New York, its agencies, officers, employees, representatives or agents with respect to any existing, pending or future claim or cause of action against the City of New York or any of its agencies, officers, employees, representatives or agents where notice is required by Federal, State or local law. Nor shall communications to the City of New York via this App be deemed to constitute legal or official notice for any other purpose. We ask all App users to use appropriate names and language in the name spaces, address spaces and other spaces (if any) provided on the App. Users are prohibited from using false e- mail addresses.

Governing Law
This agreement shall be governed by and construed in accordance with the laws of the City and State of New York, (notwithstanding New York choice of law or conflict of law principles) and the Laws of the United States, where applicable.

Jurisdiction
You agree that any and all claims asserted by or against the City arising under or related to these Terms and Conditions or your use of this App shall solely be heard and determined either in the courts of the United States located in the City or in the courts of the State located in the City and County of New York. You further agree that any cause of action arising out of these Terms and Conditions, or your use of this App, shall be deemed to have arisen from a transaction of business in the State of New York.

Amendments
We may amend these Terms and Conditions from time to time. In such event, we will post the amended terms on the App, and you will be able to read them prior to agreeing to them.

Liability
Should you choose to terminate or discontinue your use of this App, you shall nonetheless remain liable for the payment of all amounts you owe the City. You agree to pay all costs and expenses that we may incur in order to collect any amounts you owe under these Terms and Conditions. You must be a person authorized to make a payment using the credit or debit card or bank account provided to us on this App.

Miscellaneous

1. These Terms and Conditions constitute the full agreement between you and the City related to the use of this App. If any provision of these Terms and Conditions is held invalid or unenforceable, all other provisions will remain in full force and effect. The City, and any vendors or third party contractors partnered with the City to provide this App, may choose not to exercise or to delay enforcement of any of our rights under these Terms and Conditions without losing them.
2. Nothing contained in these Terms constitutes or is intended to constitute legal advice by the City or any of its agencies, officers, employees, agents, attorneys, or representatives.
3. The User agrees that if the City does not exercise or enforce any legal right or remedy which is contained in the Terms (or which the City otherwise has under applicable law), such omission will not be taken to be a formal waiver of the City’s rights and shall not be construed to be a modification of the Terms.
4. Nothing in this Agreement will act to limit the City’s ability to seek equitable relief under this Agreement.
5. The User may not assign this Agreement or any part of it, or any rights to use the App, either temporarily or permanently, to any other party. Any attempt to do so is void.
6. The City reserves the right to revise and otherwise change the Terms and Privacy Policy at any time and without notice. Any modification is effective immediately upon posting, unless otherwise stated. The User’s continued use of the App following the posting of any modification signifies the User’s acceptance thereof. The User should periodically visit this page and the Privacy Policy to review the current Terms
7. These Terms and the Privacy Policy constitute the entire agreement between the User and the City with respect to the User’s downloading and use of the App and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the User and the City with respect to the App.
