| A permit is required from the Fire Department (FDNY) to maintain or operate a facility that dispenses liquid motor fuel for automobiles. |

If constructing a new facility or renovating an existing facility, the
design and installation documents signed and sealed by a New York State
Registered Architect or Licensed Professional Engineer must be approved by the
Fire Department prior to commencing work on the facility. The design and
installation documents must show compliance with the United State Environmental
Protection Agency regulation 40 CFR Part 280 and New York State Department of
Environmental Conservation regulation 6 NYCRR Parts 612, 613 and 614, as
described in the links above. Applicants requesting a permit to take over an
existing Fire Department approved Liquid Motor Fuel Dispensing Facility may not
have to file design and installation documents.

1.
If constructing a new facility or renovating an existing facility, the applicant must file design and installation documents, signed and sealed by a New York State registered architect or licensed professional engineer, with the Department of Buildings. A job number should be obtained at the time the documents are filed.

2.
After the design and installation documents have been filed with the Department of Buildings, submit a copy of the design and installation documents, signed and sealed by a New York State registered architect or licensed professional engineer along with a copy of the Department of Buildings’ Plan / Work Application (PW1) with the job number to the Fire Department Technology Management Unit, in person or via mail.

Once the design and installation documents have been accepted by the Fire Department, the applicant may commence construction using a Fire Department licensed Motor Fuel Installer. A list of licensed Motor Fuel Installers is available at the link above.

4.
Fire Department inspections are required at various phases of the construction or renovation, from excavation to completion of construction. These inspections should be arranged by the licensed Motor Fuel Installer. At the time of the inspection, the documents listed in the Prerequisites section above will be reviewed and verified by the Fire Department inspector.

5.
Applicants requesting a permit to take over an existing Liquid Motor Fuel Dispensing Facility that will not require new installation or alteration of devices, equipment and systems previously approved by the Fire Department, must contact the Fire Department District Office Headquarters, using the contact information below, to arrange for an inspection of the facility.

6.
The premises must pass the final Fire Department safety inspection to qualify for the permit.
|

7.
Upon completion of the safety inspection, a bill will be mailed to the applicant.
|

8.
Upon successful completion of the safety inspection and payment of the bill a permit will be mailed to the applicant.
