What is a persistent violator?

You are considered a Persistent Violator of NYC TLC rules if you are a Medallion or For Hire Vehicle driver who has been:

  • Found guilty of three (3) or more violations within a fifteen (15) month period and your license has not been revoked. 
  • If you are a Medallion driver and would like further information about the Persistent Violator rule §54-27, please click on Chapter 54.
  • If you are an FHV driver and would like further information about the Persistent Violator rule §55-27, please click on Chapter 55.

If I receive a Persistent Violator summons, what must I do?

If you receive a Persistent Violator summons you will have to attend a TLC hearing.

What do I need to do if I am found guilty at a TLC hearing of being a Persistent Violator?

Medallion Driver: If you are found guilty of a summons issued under rule §54-27(b)(1)(i), you will receive a directive instructing you to attend a TLC Persistent Violator Refresher Course. This Refresher Course is mandatory and you will have 60 days from the date of the directive to attend and satisfactorily complete the course.  Failure to comply with this directive will result in the suspension of your license until you attend and satisfactorily complete the mandatory Persistent Violator Refresher Course.

Once you have completed the course please allow a few days for the school to send proof of completion to the TLC.  You can call the school to confirm whether or not your course information was sent to us.  In order to close out your summons you must then visit our LIC office at 31-00 47th Avenue, 3rd floor Compliance Unit to obtain a Receipt of Compliance. You will need to present the Receipt of Compliance to OATH on the 3rd floor in order to have your summons closed (provided you have paid any open penalties and completed all other actions necessary to close out the summons).

How long is the mandatory Refresher Course?

The mandatory refresher course is 8 hours in total, which is split into two four- hour sessions. For additional information on how long the mandatory refresher course is, please refer to the Mandatory Refresher Course Handout.

How much does it cost to take the Mandatory Refresher Course?

A fee of $75 must be paid to the school of your choice. Please refer to the Mandatory Refresher Course Handout for additional information.
