FAQs – Transportation Network Company (TNC)

The Governor of New York State recently signed into law legislation which created a new type of transportation company called a Transportation Network Company, more commonly known as a TNC. Under the new legislation, individuals who want to operate as a TNC Driver in New York State (with the exception of New York City) must be authorized by the company they will be working for to do so. Once I’m approved\authorized as a TNC Driver can I operate my vehicle in NYC?

No, in order to operate for-hire in New York City drivers need a NYC Taxi and Limousine Commission (TLC) issued license, a TLC-licensed vehicle, and the vehicle must be affiliated to a TLC licensed For-Hire Base. If I am an authorized TNC Driver, what, if anything, can I do in New York City?

You cannot operate for-hire in New York City. All you can do is drop off a passenger(s) if your trip started outside of New York City. You cannot pick anyone up inside of the five boroughs of New York City, nor can you do any point-to-point work in NYC with only a TNC authorization.

I already have a NYC TLC Driver license. Does that allow me to operate outside of New York City as a licensed TNC?

No, the NYC TLC cannot authorize you to operate as a TNC Driver. To operate as a TNC Driver outside of New York City, you need to be authorized and approved by the Business\Company you will be working for. You can get additional information by speaking directly to the company you will be working for. If the company has become a NYS DMV approved TNC, they can assist you with the authorization process. Is the new TNC Driver authorization the same as a NYC TLC Driver license?

No, it is not. A TNC Driver is not authorized to provide for-hire trip service in New York City. To operate in NYC, you must have a valid NYC TLC Driver’s license, must operate a vehicle licensed by the NYC TLC, and the vehicle must be affiliated with a Base licensed by the TLC.

Does the new law change any of the trips or services I can provide with my current NYC TLC issued Driver license?

No. The new legislation recently signed into law by the Governor does not change anything in New York City. TLC Rules and requirements and the NYC Administrative Code (Laws of the City of New York) have not changed.

Can I have both a NYC TLC Driver license and be authorized to work as a TNC Driver?

Yes. Having a TNC Driver authorization from a NYS DMV approved TNC Company would not prevent you from also holding a NYC TLC Driver license. You cannot however use the NYC TLC Driver license outside of NYC to operate as a TNC Driver, and you cannot use the TNC Driver authorization inside NYC.

If I operate as a TNC Driver in NYC without a NYC TLC Driver and Vehicle license, what will happen?

Operation of a vehicle for-hire in NYC without the necessary TLC licenses is unlicensed activity, and will subject you to fines, possible vehicle forfeiture, and possibly other penalties.

Where can I get a TNC authorization?

You will need to speak to the company that you will be working for that is planning on operating in the State of New York (outside of the City of New York) as a TNC. You can also contact the NYS DMV to get additional information.

Does my vehicle need any other license (other than being registered with the DMV as a passenger vehicle) to be used as a TNC?

No, but you should contact the company you will be working for to see if your vehicle will be acceptable to them. Please visit the NYS DMV website to get this information.

I have a NYC TLC issued vehicle license. Can I use my vehicle with my NYC Taxi and Limousine Commission plates to operate as a TNC outside of NYC?

No. If your vehicle is licensed by the NYC TLC, you cannot use it as a TNC Vehicle. To get additional information on vehicle requirements, please speak to the company you will be driving for, or contact the NYS DMV.

I use an app on my phone to take trip calls. Will the app work in NYC?

Please speak to the app company. You should not be able to take a trip\service call as a TNC Driver inside the City of New York, but bases and dispatch providers licensed by NYC TLC can continue to offer for-hire service provided that they meet the requirements of TLC rules.

How do I get authorized to operate as a TNC Driver?

You need to reach out to the Company you will be working for. You can also go to the NYS DMV’s website to get additional information.

Can I be a sole proprietor and operate as a TNC?

In order to get specific information on this you will need to contact the NYS DMV. The NYC TLC is not involved with the licensing of TNC’s.
