Department of Education and District Attorney's Offices Refunds Mailed
The tax year 1989, 1990 and 1991 refund checks for Department of Education LoDI FICA refunds claimed were dated 9/8/2009. The tax years 1994 and 1995 refund checks were dated 9/21/2009. The tax years 1996 refund checks were dated 9/23/2009. The tax years 1997 and 1998 refund checks were dated 9/24/2009. The tax year 1999 refund checks were dated 9/25/2009. The tax year 2000 refund checks were dated 9/28/2009. The tax year 2001 refund checks are dated 9/21/2009. The tax year 2002 refund checks are dated 9/29/2009. The tax year 2003 refund checks are dated 9/30/2009. The tax year 2004 refund checks are dated 5/14/2010. The tax year 2005 refund checks are dated 9/30/2009. LoDI Refund Claim
The City has reached a settlement with the Internal Revenue Service (IRS) involving FICA (i.e. Social Security & Medicare) tax refunds to both the City and eligible employees of the City’s Department of Education and District Attorney offices of New York, Bronx, Queens, Kings, Richmond Counties and Special Narcotics. The years covered by this settlement are 1989 through 2005. Eligible employees of these departments who were on authorized Line of Duty Injury (LoDI) leave at some point during the years 1989 through 2005 will likely be eligible for a refund of the FICA taxes paid on LoDI payments received for a period of six months or less. Department of Education employees are eligible from 1989 while District Attorney’s Offices employees are eligible from 1995.
Please note that LoDI payments received for a period of greater than six months have previously been deemed to be exempt under a separate statutory provision and thus are not part of this refund.
In order to collect a refund in connection with this settlement, eligible Department of Education and District Attorney offices of New York, Bronx, Queens, Kings, Richmond Counties and Special Narcotics employees must submit a signed consent form to the City allowing the City to collect the refund on the employees’ behalf. Once the IRS refunds the monies to the City, the City will then remit the money to the employee. In the absence of a signed consent form from an employee, that employee will not be able to participate in this settlement. Moreover, that employee may be forever barred from collecting a refund of these amounts since his/her time for filing an individual refund claim will likely have expired.

Deadlines
The Office of Payroll Administration (OPA) gathered the data it needed to reach out to every affected employee. On Friday, August 29, 2008, OPA mailed the letters explaining the refund process and the years for which that employee may be entitled to a FICA refund. Enclosed with this letter was the consent form employees were required to sign and return to the City in order to collect their refund. IN ORDER TO OBTAIN YOUR REFUND you must complete the enclosed consent form by circling Y for Yes for each year that you may be eligible for a refund. Then sign and mail the consent form to the address listed on the bottom of the form by Friday October 31, 2008. ABSOLUTELY NO EXTENSIONS WILL BE GRANTED. You must circle Y for Yes and sign the consent form even if you dispute the amount(s) in order to receive a refund. Failure to return the consent form to the City by Friday October 31, 2008 will prevent you from being able to obtain your share of the refund in connection with the City’s refund claims. In addition, your failure to timely return the consent form may prevent you from receiving any refund of these FICA taxes paid as your time for filing an individual claim with the IRS may have already expired. Those individuals who timely return the consent form to the City will receive their refund from the City once the IRS refunds the money to the City.
