MAYOR GIULIANI SIGNS COUNCIL BILL NO. 936, ELIMINATING TWO MEDICAL EXAMINER REQUIREMENTS AT HOMICIDE AUTOPSIES

REMARKS BY MAYOR RUDOLPH W. GIULIANI AT PUBLIC HEARING ON LOCAL LAWS

The last bill before me is Introductory Number 936, a bill sponsored at my request by Council Members Fusco, Berman and Povman. This legislation would amend the Administrative Code to eliminate the requirement that two medical examiners be present at the autopsy of a homicide victim.

This requirement was enacted approximately 40 years ago, before modern photography, x-ray techniques and other forensic examination and documentation practices were available to preserve evidence. Eliminating the presence of a second medical examiner will not only minimize competing borough caseload assessments, but will maximize budgetary and manpower allocations for each medical examiner's office.

It should also be noted that this measure has the support of the City's five district attorneys.

For the reasons previously stated, I will now sign this bill.
