MAYOR GIULIANI SIGNS COUNCIL BILL NO. 1043-A, AMENDING THE ADMINISTRATIVE CODE IN RELATION TO SIGNS AND FEES FOR PRIVATE BOOTING COMPANIES
REMARKS BY MAYOR RUDOLPH W. GIULIANI AT PUBLIC HEARING ON LOCAL LAWS
The next bill before me is Introductory Number 1043-A sponsored by Council Members Eisland, Dear, Duane and Koslowitz. This bill amends the Administrative Code in relation to signs and fees for private motor vehicle booting companies. Booting occurs when a company attaches an immobilizing steel clamp -- a "boot" -- to the wheel of a car that may be parked illegally in a private parking area. The company then charges a fee to remove the "boot."
Specifically, this legislation would set minimum size requirements for all lettering on signs that serve to inform the consumer of the hours and circumstances under which such vehicles are prohibited from parking on such property. Lettering requirements would also be mandated for all information that is provided about the name, business address, telephone number and license number of the person authorized to boot the motor vehicles on said property.
Finally, Intro. 1043-A, reduces the permissible fee for booting a motor vehicle to a maximum of $25, reduced from the present maximum fee of $100.
Similar to Intro. 987-A, this legislation furthers the City's efforts to ensure the protection of consumers by reducing the types of abuses by booting companies.
This legislation will make the signs clearer, easier to read and more noticeable, thereby reducing the chances that a consumer can be misled into believing they are parking legally and then are fined in order to have a boot removed.
For the reasons previously stated, I will now sign the bill.
