In accordance with Section 24-09 of Chapter 24 of Title 15 of the Rules of the City of New York, the Office of Environmental Remediation (OER) is required to impose a fee for review and approval of alteration and development actions on E-Designation sites and/or recorded Hazardous Materials Restrictive Declaration sites.
An applicant seeking approval of minor alterations resulting in the issuance of a "Notice Of No Objection" for E-Designation sites and Hazardous Materials Restrictive Declaration sites is required to pay a $375 fee. Examples of minor alterations include, but are not limited to, projects with:
- no soil disturbance;
- no change of use, occupancy, or egress;
- no change of windows;
- or no change of stack location, boilers and HVAC systems, or fuel types.

Development Projects Requiring a Phased Review and Sign-Off
An applicant whose development project requires a phased review resulting in the issuance of a "Notice To Proceed" and subsequent "Notice Of Satisfaction" for E-Designation sites and Hazardous Materials Restrictive Declaration sites is required to pay a $1,050 fee for each phase review preformed by OER (phase fee). Examples of development actions requiring a phased review include, but are not limited to, commercial and/or residential projects with:
- new buildings;
- alterations involving soil disturbance;
- alterations requiring a new Certificate of Occupancy, such as a change of use from commercial to residential;
- alterations involving a change of windows; or
- alterations involving stack locations, boilers and HVAC systems, or fuel types.

Fee payments should not be submitted until OER has issued a formal fee payment request for a specific site with an assigned OER project number.
State Department of Environmental Conservation Fees and Taxes
