Local Law 86 of 2005 (LL86) Reporting for 2009

LL86 mandates that the Mayor's office report each year on the number and size of projects subject to its provisions as well as on specific costs and benefits related to the law's requirements.  For the second report due September 1, 2009, the Mayor's Office of Environmental Coordination (MOEC) has developed the two reporting forms referenced below to fulfill this mandate. Agencies that control city expenditures on LL86 projects must submit the appropriate form for each project that has started design since the effective date of the law.  This includes updating and resubmitting of required information on each project reported in the previous year, unless such a project has been completed and all required reporting information has been previously submitted.

All completed forms must be submitted electronically to LocalLaw86@cityhall.nyc.gov prior to July 31, 2009.  Agencies should use either the 2009 REPORTING FORM for Project Subject to the LEED® Rating and/or Water Use Reduction Provisions of Local Law 86 of 2005 or the 2009 REPORTING FORM for Project Subject to the System Specific Energy Cost and/or Water Use Reduction Provisions of Local law 86 of 2005.  The first form should be used only for projects subject to the LL86 LEED® provisions, and the second only for boiler, lighting, and HVAC comfort control installations subject to the 5-10% energy cost reduction provisions as well as for projects subject to only the water use reduction provisions.

The Design Phase portion of each reporting form must be completed for covered projects that have started design before the end of Fiscal Year 2009 (FY09), where the beginning of the design phase is defined as the date the Mayor’s Office of Management and Budget (OMB) approved the Certificate to Proceed (CP) for Design or the CP for Design and Construction.

The Construction Phase portion must also be completed for covered projects that have also started construction before the end of FY09, where the beginning of construction is defined as the date a Certificate to Proceed (CP) for Construction is approved by the OMB or, in cases where a CP for Construction is not required, when the first construction contract is awarded.

Finally, for a project subject to a LEED® provision where the required LEED® related submittals are completed and/or certification by the USGBC is achieved before the end of FY09, the Post-Construction portion of the reporting form must also be filled out.
