Application for an Exemption from Provision(s) of Local Law 86 of 2005

Pursuant to Executive Order 97 of 2006, which authorizes the Director of the Mayor's Office of Environmental Coordination (MOEC) to exercise the powers and the duties granted to the Mayor in connection with Local Law 86 of 2005 (LL86), MOEC may grant an exemption, in whole or in part, from one or more of the requirements of the law if, in the Director's determination, such exemption would be in the public interest and if the value of exemptions granted is less than 20% of the dollars allocated in a single fiscal year.

Where an exemption is sought, the reporting agency must complete the APPLICATION FORM for an Exemption from Local Law 86 of 2005 Provision(s) as well as the design phase portion of the applicable LL86 reporting form (see LL86 of 2005 Reporting for 2009 ).  All completed forms should be submitted electronically to the LocalLaw86@cityhall.nyc.gov .

The Director of MOEC will inform the reporting agency in writing of the specific exemption(s) granted within a reasonable period after receipt of the request, usually within 30 days. Note that, in appropriate circumstances, the Director of OEC may grant a lesser exemption than that sought by an agency.
