Local Law 86 Reporting

LOCAL LAW 86 OF 2005 REPORTING GUIDELINES

Local Law 86 of 2005 (LL86) requires the Director of the Mayor’s Office of Environmental Coordination (MOEC), as the representative of the Mayor, to publish a report each fiscal year (FY) that describes key attributes of projects subject to LL86 as well as the costs and benefits related to compliance.  The managing agency, i.e. either the city agency managing construction of a project or the agency that holds a funding agreement with a non-city entity that is managing construction, is responsible to ensure that data is provided in accordance with the reporting guidelines described on this page.

Three reports to date have been published using data reported by managing agencies to MOEC. To collect data for the LL86 Annual Report, the NYC Department of Citywide Administrative Services (DCAS) Division of Energy Management (DEM) and the Department of Information Technology and Telecommunications (DoITT) are developing a web-based tracking system, the Sustainability, Energy, and Property Tracking System (SEPTS), to enable agencies and MOEC to expedite data collection and to more easily aggregate reported data.  

Once SEPTS is launched, managing agencies should enter all requested data directly into SEPTS for each LL86 project in their portfolios that received an OMB approved Certificate to Proceed (CP) or CBX Certificate during or before the FY covered by the report.  In the meantime and to facilitate the collection of data internally and from non-city entities, the managing agency should utilize the offline forms available from MOEC.

Design Tab
Each project or project phase that is subject to one or more LL86 requirements must be reported on this tab if it has received an initial OMB approved Certificate to Proceed or CBX Certificate during or before the FY covered by the report, including projects that have received, applied for, or intend to apply for a whole or partial exemption from one or more LL86 requirements.  Fields must be updated each subsequent FY, using actual data or the most current estimates available, up to and including the year the project reaches final completion, i.e. until construction is substantially complete, all city funds to be spent on the project have been released from the city treasury, and all applicable LL86 requirements have been met.

Construction Tab
The Construction Tab must also be completed for each project or project phase that started construction during or before the FY of the report.  Using actual data or the most current estimates available, fields must be updated each subsequent FY up to and including the year the project reaches final completion.  If a project receives a full or partial exemption from one or more requirements but is still subject to at least one, in whole or in part, the managing agency must also complete this tab. 

Post-Construction Tab
The Post-Construction Tab must be completed for each project or project phase that reached final completion during or before the FY of the report. And, again, if a project receives a full or partial exemption from one or more requirements but is still subject to at least one, in whole or in part, the managing agency must also complete this tab. 

Post-Occupancy Tab
The Post-Occupancy Tab will be completed automatically by SEPTS for those projects or project phases where energy use affected by project work is metered independently and where all costs for this use is paid from the city treasury, or where potable water use is metered independently.
