The regulations guiding the process of environmental review under the State Environmental Quality Review Act include a list of actions, identified as Type II actions, for which environmental review is not required. These regulations permit local agencies and municipalities to designate a supplemental list of actions as Type II. Accordingly, as part of the City’s ongoing process reform for environmental review, the Mayor’s Office of Environmental Coordination and the Department of City Planning have recommended promulgation of a supplemental list of citywide and agency-specific Type II actions. The proposed rules, which are set forth below the Notice of Public Hearing, would exempt thirteen (13) actions from environmental review, simplify the environmental review process for applicants and allow agencies to focus scarce resources on other issues. This proposal would not exempt projects from ULURP or otherwise affect land use review procedures.
To determine whether significant impacts would result from designating these actions as Type II, an Environmental Assessment Statement was issued on October 4, 2013 and includes the background, history, and environmental review outcomes for all of the actions that are proposed for inclusion on the Type II list. A Negative Declaration was issued on October 7, 2013.
On October 7, 2013, the proposed rules were presented to the City Planning Commission and the City Planning Commission approved publication of the Notice of Public Hearing. To begin the rulemaking process, the Notice of Public Hearing was published and distributed in accordance with the City Administrative Procedure Act § 1043(b) and Executive Order 133. A public hearing on the proposed rules was held on November 20, 2013 at 10:00 A.M. at Spector Hall, 22 Reade Street, New York, NY 10007. The City Planning Commission then considered comments received and unanimously adopted the new rules on December 18, 2013. The new rules are effective beginning on January 26, 2014.
