Paralegal repeatedly accessed explicit materials on work computer.

ALJ John Spooner recommended termination for a 73-year-old paralegal found to have opened, sent, and printed sexually explicit e-mails, images, and videos. In determining the appropriate penalty, ALJ Spooner took into account that the respondent failed to perceive the inappropriateness of his conduct, instead taking from the incident only that he should avoid e-mail in the future.

Licensing


License revocation recommended for taxi driver for criminal conviction.

The Taxi and Limousine Commission sought to revoke the license of a for-hire vehicle driver who had been convicted of aggravated driving while intoxicated. ALJ Lewis noted that though the arrest occurred while the driver was off duty, there was a direct relationship to the crime and his duties. Accordingly, she found that the driver was unfit and recommended that his for-hire license be revoked.
