Summary: Chapter 438 of the Laws of 1993
amends the NY State Public Health Law and the Environmental Conservation Law regarding the regulation of medical waste. The Department of Health has responsibility to maintain the definitions of regulated medical waste for the state, and oversees the handling of such waste in hospitals and nursing homes. The Department of Environmental Conservation has regulatory oversight of the storage, transportation and disposal of regulated medical waste for all relevant generators, handlers, transporters and destination facilities.
