Summary: The NY Dental Mercury & Amalgam Recycling Law, enacted as Chapter 506 of the Laws of 2002
, requires dentists to recycle elemental mercury, including any pre-encapsulated mercury capsule waste, and dental amalgam waste generated in their dental practices. The law requires the installation of certified mercury amalgam separation and collection equipment, and prohibits the use of non-encapsulated elemental mercury in dental offices. It is prohibited to discard of dental mercury as municipal solid waste, regulated medical waste, or be flushed down the drain.
The regulations specify record keeping requirements to show proof of mercury recycling. Dental mercury waste must be stored in air-tight containers for no longer than one year at dental facilities before recycling.
