Summary: NY State passed legislation to amend the Labor Law to conform to Federal asbestos requirements in the Asbestos Hazard Emergency Response Act (AHERA), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Occupational Safety and Health Administration (OSHA) Asbestos Standard for the Construction Industry. The law requires appropriate training and certification of persons - employees, supervisors, employers - involved in all aspects of an asbestos project, and by setting forth standards and procedures, notification requirements, and record-keeping and reporting mandates for all aspects of asbestos projects.
The Department of Labor Asbestos Control Bureau has inspection and enforcement authority for the program.
