In accordance with City Charter requirements, the Regulatory Agenda was published in the City Record on May 1, 2008.
STATED BELOW IS THE REGULATORY AGENDA OF THE NEW YORK CITY Procurement Policy Board (PPB) for the next fiscal year, as required by the City Administrative Procedures Act (CAPA), New York City Charter Section 1042.
The PPB is authorized to promulgate rules governing the procurement of goods, services and construction by the City of New York under Chapter 13 of the Charter of the City of New York. The Rules became effective September 1, 1990. Modifications may be necessary to address issues that have arisen in the implementation and meaning of the Rules.
The PPB anticipates that it may promulgate various amendments to its Rules that will govern every phase on contracting by City agencies. Such amendments may include the following subject matter areas, among others:
- Multi-Term Contracts (Client Services) (§2-04)
- Competitive Sealed Proposals (§3-03)
- Contract Changes (§4-02)
- Responsiveness of Bids/ Proposals (§2-07)
At this time the Board cannot summarize particular changes that may be adopted or other significant issues and priorities that may arise as a result of its Annual Rules Development Hearing. Should the need for new rules arise, the Board will propose them in a timely manner.
The individuals and entities likely to be affected by the proposed rules include City agencies, suppliers, agency contract staff, and the general public interested in the administration of City government.
