Public Hearing Process

The LPC receives over 9,000 applications each year from owners who wish to make changes to their landmarked properties. Approximately 95 percent of applications are reviewed the agency's professional staff, which uses LPC's Rules to determine whether the proposed work is appropriate. The remaining applications must be reviewed by the commissioners at a public hearing if the proposed work is not covered by LPC rules. Public Hearings allow an applicant to present proposals to the eleven LPC Commissioners and explain why he or she believes the proposed work is appropriate. The hearing is also an opportunity for public testimony and discussion about the application. Staff will inform you of the next available hearing date you may be scheduled for, based on the completeness of your application.

Preparing for your Public Hearing

The first step in the process is to meet with your assigned LPC staff person to discuss the project and presentation requirements. Please allow 2-3 weeks for this part of the process.

Community Board: You should contact the community board early in the process—prior to being placed on an agenda— to ensure that you can complete their process before the Public Hearing date. You should not present your material to the community board until you have submitted it to the staff and the staff has determined the presentation to be complete. LPC staff strongly recommends you present the same presentation to the CB that you plan to present at the Public Hearing; and that you do not make any major changes to the proposal after the CB review. You may make minor changes to your presentation, but please discuss it with the staff first.

Additions & New Construction: If your application is for the construction of an addition or a new building, you will need to submit a copy of the Department of Buildings Objections Sheet before your application can be placed on a public hearing agenda. The Objections Sheet must be cleared of zoning objections by the Wednesday [chair's prep] prior to the hearing date. If the proposal is for an addition, a mock-up is required.  Your presentation should include photographs of the mock-up from all viewpoints on the surrounding street, and photomontages of these views. Your assigned staff person will discuss this procedure with you. The mock-up must be in place prior to the community board review.

One month before the hearing date:

The deadline to complete your submission is approximately one month before your hearing date. You will be working with the staff prior to this time and once they determine the presentation material is complete, the staff will add the item to the next available agenda. You will need to confirm that you have been scheduled for a Community Board review by this time, and confirm where you are in the Department of Buildings process if an Objections Sheet is required.

Two weeks before the hearing date:

Your finalized presentation is due. This may include presentation boards, a digital presentation (PDF), and/or material samples. Digital presentations may be submitted on a USB    drive, CD, or e-mail (10MB file size maximum). If materials are submitted after this date, the project may be laid over to a future hearing date. If you are using a digital presentation, please provide a CD with a copy of the presentation and five 11”x17” hand-out copies of the presentation. 11 copies will be required before the public hearing date.

Friday before the hearing date:

The estimated time schedule for your hearing date will be made public and posted to the LPC’s website at www.nyc.gov/landmarks.  LPC also posts a “Be Here” time to allow for flexibility if the agenda is ahead of schedule. Times are subject to change and all presenters should keep their schedules flexible on the date of the hearing. A materials review session is made available from 10:00 am – 2:00 pm for member of the public to preview the presentation materials.  If you have taken any of your materials after submission (boards, material samples) in order to present to the community board, etc., you must ensure that they are returned to the Commission’s offices prior to the start of this 10:00 am review session.

One Day before the hearing date:

The community board review must be complete. If the community board review is not complete by this date, the item will be laid over.

Day of the public hearing:

You should arrive at the public hearing 45 minutes prior to your scheduled time. If your presentation is in a digital format, or if the project is for a new building or visible addition, please bring eleven 11"x17" hand-out copies of your presentation and a USB back up. If boards or digital presentations have color images, hand-out copies should also include color images; text and images should be sufficiently sized and clear for adequate legibility.
