2-11(b)(1)(i) Late Filing Fee Rule
Effective July 1, 2008 registration period if an owner fails to submit the annual renewal registration application and fee by July 31, the Loft Board will assess the owner a late filing fee of $25.00 for the month of July for each residentially occupied unit. Thereafter the Loft Board will assess the owner an additional late filing fee of $5.00 per residentially occupied unit for each month or portion of a month until the date when the application is submitted and the fee is paid.

2-11(b)(1)(i) to Increase the Registration Fee

Extension Applications
Owners seeking an extension of time to comply with the legalization deadlines may no longer seek an extension for a deadline that already has passed. Thus, no extension will be granted to extend the deadline for filing an alteration application, or for obtaining a permit because these deadlines (September 1, 1999  and March 1, 2000 respectively), already have passed.

Abandonment Rule Has Been Amended
Any owner seeking a finding of abandonment for an IMD unit must file the application within one year of the date the unit was abandoned.  Deregulation will occur only if the owner has obtained a certificate of occupancy and filed an application for a final rent order and/or removal from the Loft Board's jurisdiction within one year from the earlier of (1) the granting of the abandonment application, or (2) expiration of the deadline for obtaining a certificate of occupancy.

These rule changes prohibit owners from enjoying the benefits of a deregulated IMD unit as a result of abandonment without undertaking the necessary and reasonable steps to legalize their buildings in accordance with the Loft Law.
