Division of Liens & Recovery
The Division of Liens and Recovery Casualty Program places liens and asserts claims against the personal injury lawsuit settlements of past or present recipients of Medicaid and Cash Assistance pursuant to NYS SSL 104 and 104-b. At the time of a lawsuit settlement, law firms and insurance companies must contact the Division to obtain a final lien amount. Total settlement amount from all defendants is needed to discuss lien re-payment.
The Real Property Program places liens on real estate, including homesteads, within New York City owned by Cash Assistance and Nursing Home Medical Assistance applicants. The liens are repaid at the time the property is sold or refinanced. Title companies and law firms can contact the program and request a payoff amount.
To expedite requests, submit information for updated and final lien amounts on the following form; or print the Client Information / Lien Request form (in PDF) and fax to: 212-274-4988 or 212-274-5603.
Providing the following information will allow Liens & Recovery to calculate lien amounts in a timelier manner:
- Plaintiff's Name, Social Security Number, and Date of Birth
- Date of Occurrence – Place of Occurrence
- Nature of Injury
- Claim / File Number
- Name & Address of each allegedly liable Third Party, their Attorney & Insurance Company
- Caption & Index Number of the personal injury lawsuit
- Copy of pleadings
The Division of Liens and Recovery cannot accept or endorse two-party checks for deposit.
