Overview of Fire Department Rules

  1. Overview of Fire Department Rules
    • Pursuant to its authority under NYC Administrative Code Section (§) 29-103, the Fire Commissioner is responsible for the administration and enforcement of the New York City Fire Code (FC). This includes the power to promulgate rules that implement the Fire Code and to otherwise carry out the duties and exercise the powers granted to the Fire Commissioner and the Fire Department pursuant to NYC Charter Chapter 19 and FC104.
    • The Fire Department’s rules are codified in Title 3 of the Rules of the City of New York (RCNY).
    • The section number of each rule parallels the applicable Fire Code section number.  For example, rules relating to Certificates of Fitness (FC113) are numbered 113-01, 113-02 and so forth.
    • The Fire Department will be amending some of its current rules, and promulgating new rules, to implement the provisions of the 2014 Fire Code, which was enacted by Local Law No. 148 of 2013, effective March 30, 2014.

  3. Proposed Rulemaking Notices and Comment Form
    • In accordance with the New York City Administrative Procedure Act (New York City Charter §1043), each proposed agency rule or rule amendment, and each final agency rule or rule amendment that is subsequently adopted, is published in the City Record, a daily publication of the New York City Department of Citywide Administrative Services (DCAS). For additional information about the City Record, contact DCAS at Municipal Building, 1 Centre Street, Room 2208, New York, NY 10007, or visit its website: www.nyc.gov/cityrecord.
    • Proposed rules will be available on this website until publication of a final rule. To view proposed rulemaking notices, click here.
    • The public can submit comments on proposed rules by mail or online, from the New York City Rules website, or by using the Proposed Rulemaking Comment Form on this website.  To submit comments on a proposed rule, click here.  Please note that comments must be submitted within the time specified in the rulemaking notice.
    • The Proposed Rulemaking Comment form is for use in submitting comments on proposed rules.  To obtain guidance with respect to current provisions of the Fire Code or Fire Department rules, use the Public Inquiry Form (see below or click here).
    • Final rules will be available on the Fire Department’s website for at least 90 days after publication in the City Record.  To view notices of final Fire Department rules adopted in the last 90 days, click here.
    • The Fire Department will e-mail proposed rulemaking notices to interested parties.  To receive the notices by e-mail, print and complete the CAPA Distribution List Request Form (click here for the form) and mail it to the Fire Department’s Bureau of Legal Affairs, 9 MetroTech Center, 4th Floor, Brooklyn, NY 11201-3857.

    • The Fire Department endeavors to promptly respond to all inquiries, but due to the volume of inquiries, may not be able to respond to every inquiry.
    • The Fire Department posts responses to inquiries of general concern on the Frequently Asked Questions web page to provide official guidance with respect to the Fire Code or Fire Department rules.
