If the Department of Buildings or the Fire Department is the City agency that gave you the ticket, you may be allowed to avoid paying a fine by fixing the problems on the ticket and telling the agency that you did so. This is called curing the violation. If you cure the violation you will not have to come to ECB for a hearing.
You must fix the problems and tell the agency before the cure date stated on the ticket. This date is always before the scheduled hearing date.
Are you eligible?
Check your ticket to see if it has a box labeled ”Cure Date” or “Order to Correct and Certify Correction.” If your ticket has this section and the issuing officer has filled it in, then you are eligible.
What do you need to do?
Follow the specific instructions provided by the Department of Buildings or the Fire Department to correct the violation and certify the correction.
What happens?
If the City agency agrees that you have fixed the problems stated on the ticket and filed the right papers before the cure date stated on the ticket, the agency will send you a letter. This letter says the agency has accepted your proof. ECB will send you a decision. The decision will say that you have been found guilty. The amount of the fine will be zero (0) dollars. You will not have to come to ECB for your hearing. You will not be able to appeal the decision. ECB's decision will be sent to you in the mail.
If the City agency does not agree that you have fixed the problems stated on the ticket and filed the right papers before the cure date stated on the ticket, the agency will send you a letter stating your cure has been rejected. If this happens, you must attend a hearing at ECB.
