Resolution without a Hearing: Curing the Violation

If you have received an NOV from the Department of Buildings or the Fire Department, that Department may allow you to cure the violation. Specifically, you may be able to avoid a hearing and penalty by correcting the violation within a specified time period and certifying the completed correction to the appropriate City agency before the date indicated on the NOV. Please note that the cure date is always before the first scheduled hearing date.

Are you eligible?
Check your NOV to see if it has a section labeled "Cure Date" or "Order to Correct and Certify Correction." You are eligible if your NOV has this section and it was completed by the officer who issued your violation.

What do you need to do?
Follow the specific instructions provided by the Department of Buildings or the Fire Department to correct the violation and certify the correction.

What happens?
If the City agency is satisfied with the certification, you will receive a notice of acceptance from the agency. ECB will find you in violation, but you will have a zero penalty. You will not need to appear for a hearing and you cannot appeal the decision. You will receive ECB's decision and order in the mail.

If the City agency is not satisfied with the certification, you will receive a letter from the agency stating that it has been rejected. If this happens, you will have to attend a hearing at ECB.
