PRESS ADVISORY: BOARD OF HEALTH TO MEET
ON TUESDAY, SEPTEMBER 17, 2002


Notice is hereby given that the Board of Health will hold a meeting on Tuesday, September 17 2002 at 10:00 A.M. The meeting will be held at 125 Worth Street, in the Third Floor Boardroom, Room 330, New York, NY. The agenda will be as follows:

APPROVAL OF MINUTES
1.Approval of minutes of meeting held June 13, 2002.

NEW YORK CITY HEALTH CODE

2. (A) Proposed resolution to amend Section 1.03 and other provisions of the NYC Health Code to change references to Department and Commissioner of Health to Department and Commissioner of Health and Mental Hygiene.
(B) Proposed resolution to amend Board of Health resolutions to change references to Department of Health to Department of Health and Mental Hygiene.

3. Proposed resolution to amend Section 3.12(a) of the NYC Health Code to increase the minimum penalty for a violation of the Health Code from the current amount of one hundred dollars to two hundred dollars; to amend Section 3.12(b) to increase the minimum penalty for a person, corporation or entity engaging in an activity without a required license, permit or registration authorized by the Department from two hundred dollars to one thousand dollars, and to provide that when a person duly served with a Notice of Violation of a provision of the Health Code fails to appear for a hearing and is found in default, the penalty for such violation shall be doubled.

4.Proposed resolution to amend Section 81.05(c) of the NYC Health Code to prohibit the operation of a food service establishment or non-retail food processing establishment unless a request for a pre-permitting inspection is submitted to the Department not less than twenty-one days before the establishment commences operations.

5. Proposed resolution to amend Sections 81.15(a) and 89.03(b) of the NYC Health Code to provide that no mobile food vendor license shall be issued unless the applicant has successfully complete a food protection course.
