BOARD OF HEALTH TO MEET ON
THURSDAY, DECEMBER 12, 2002


Notice is hereby given that the Board of Health will hold a meeting on Thursday, December 12, 2002 at 10:00 A.M. The meeting will be held at 125 Worth Street, in the Third Floor Boardroom, room 330, New York, NY. The agenda will be as follows:

NEW YORK CITY HEALTH CODE

2. (A) Resolution to amend Section 1.03 and other provisions of the NYC Health Code to change references from Department of Health and Commissioner of Health to Department of Health and Mental Hygiene and Commissioner of Health and Mental Hygiene. Printed in The City Record on September 23, 2002. No public hearing was held since these changes are not substantive and are required as a matter of law.

3. Resolution to amend Section 3.12(a) of the NYC Health Code to increase the minimum penalty for a violation of the Health Code from the current amount of one hundred dollars to two hundred dollars; to amend Section 3.12(b) to increase the minimum penalty for a person, corporation or entity engaging in an activity without a required license, permit or registration authorized by the Department from two hundred dollars to one thousand dollars, and to provide that when a person duly served with a Notice of Violation of a provision of the Health Code fails to appear for a hearing and is found in default, the penalty for such violation shall be doubled. Printed in The City Record on September 23, 2002. A public hearing was held on October 24, 2002. Two people testified and three written comments were received.

4.Resolution to amend Section 81.05(c) of the NYC Health Code to prohibit the operation of a food service establishment or non-retail food processing establishment unless a request for a pre-permitting inspection is submitted to the Department not less than twenty-one days before the establishment commences operations. Printed in The City Record on September 23, 2002. Public hearing was held October 23, 2002. No one testified and no written comments were received. One person appeared and asked a question, but did not testify on the merits of the proposal.

5. Resolution to amend Sections 81.15(a) and 89.03(b) of the NYC Health Code to provide that no mobile food vendor license shall be issued unless the applicant has successfully complete a food protection course. Printed in The City Record on September 23, 2002. Public hearing was held October 23, 2002. Three people testified and one written comment was received.
