Inspections

A pre-permit inspection of the fully-equipped establishment is required to determine if it complies with the New York City Health Code, the New York State Sanitary Code and other applicable regulations related to food service and administered by the Department of Health. Passing the pre-permit inspection does not indicate compliance with the requirements of any other City agency.

Violations are categorized (see sample of the reverse side of the inspection report form) as:

Critical Items:

    These items relate directly to the protection of the public from food borne illness. They must receive immediate attention.

    Public Health Hazards: These items are identified with an asterisk (*) and must be corrected immediately. Failure to correct any one of these items, on any inspection results in the establishment being ordered to close and cease all food operations.

    Pre-permit Serious Items: These items are identified with a plus sign (+) and when cited during a pre-permit inspection prevents the approval of the permit.

General Items:
    These items relate to maintenance of food service operations and cleanliness. These items should be corrected by the next regular inspection or the reinspection date indicated on the inspection report. Within the category of General Items, violations are further categorized as Class B, C and D.

All violations are considered in determining the result of an inspection, when a Notice of Violation (NOV) is issued and a reinspection scheduled.

Failure to pass a pre-permit or routine inspection may result in the issuance of an NOV. Failure of two subsequent compliance inspections while your business is in operation will result in the closure of your establishment.

Operators are encouraged to use the reverse side the Food Establishment Inspection Report (198E), on the following page, to conduct periodic reviews of their establishment(s) to ensure compliance.
