Senior Citizen Rent Increase Exemption (SCRIE)
Information for Building Owners and Landlords
Notification of a Tenant’s SCRIE Eligibility
An Order of Approval or Denial is sent to the tenant and the landlord. If the tenant is approved, a notification showing the exemption period, the amount the tenant is responsible for paying, and the amount of the Tax Abatement Credit (TAC) will be mailed to the building owner or landlord.
When the tenant receives the Owner Approval Order, building owners or landlords must repay the tenant any retroactive portion of the rent. The tenant will stop paying the full collectible rent and begin paying only the portion authorized under the SCRIE Program.
Tenant Reports
The reports below show current or recent SCRIE tenants’ status and SCRIE benefit information. Landlords can use these reports for a variety of reasons, including to track if a tenant's benefit is about to expire. If a renewal application is not received or incomplete, this will delay the renewal of the SCRIE benefit.

Building Owner’s Tax Abatement Credit (TAC)
Finance keeps a SCRIE account for each building owner or landlord to track TAC credits and debits. Finance applies credits from the building owner or landlord’s account to offset any taxes due the next tax period. The building owner or landlord receives a quarterly Statement of Account reflecting credit or debit activity.

Refunds for Excess SCRIE Credits
A building owner or landlord may apply for excess SCRIE tax credits in the form of a refund. Credits will be used to pay any past due taxes. Owners may request excess SCRIE credit be refunded by completing a Property Refund Request.
The Appeal Process
A building owner or landlord who believes a tenant does not qualify for the SCRIE benefit may appeal the tenant’s SCRIE approval. An Appeal must be filed within 60 days of the Owner Approval Order, with all required supporting documentation. The building owner or landlord must notify the tenant of an appeal and the reason for the appeal in writing.
After review, the SCRIE Unit will notify the building owner or landlord if more information is needed. If not, a hearing will be scheduled, or a decision will be made.
Adjustment of Legal Rent Based on Casado v. Markus This form is for landlords and/or their managing agents wishing to adjust a Tax Abatement Credit (TAC) because of a change in a tenant’s legal rent pursuant to Casado v. Markus, in which the Court of Appeals upheld the original NYC Rent Guidelines Board orders regarding leases of rent-stabilized apartments for years ended September 30, 2009, and September 30, 2010 (RGB 40/41). Use this form to request adjustments to the TAC for those SCRIE tenants residing in your property who received revised leases increasing the legal rents to conform with the original NYC Rent Guidelines Board Order(s). You must attach each tenant’s newly adjusted lease, signed by both you AND the tenant and clearly indicating the lease term.
